Subject: Help please!
  My husband is a Canadian citizen, Native with no borders and I´m a US citizen. We met and lived in the US for a few years, got married and had a baby there. We then moved up to Edmonton a few years ago. Our daughter got dual citizenship and I got temporary visa. We went through a hard spell when my husband lost his job and we had to move in with his family. During this hard time renewing my temporary visa completely slipped my mind as we where frantically trying to keep our family afloat. Now he has a job and we have our own place and my visa has expired 6 months ago. I found out that I am 2 months pregnant now and Im not sure what to do. With my first daughter I had alot of problems during the pregnancy so I really need to be seeing a doctor, but since we are just now getting on our feet again we have NO extra money to pay out of pocket for a doctor. I know I have to renew my visa but i´m scared of what might happen. Will they send me back to the US?? Can I get some sort of medical for my pregnancy?? What will happen when I try to get my visa problems taken care of?? Any help is great appreciated! Please respond asap here or email me please lillithu@hotmail.com Thank you

When you ask so many questions number them it will make everyones attempt at answering them easier.

1. I assume you mean you had a work permit or a student permit, correct?
2. You can not re-enstate your SP/WP visa or even visitor status because your long out of status.
3. To become a visitor again go across the border and turn back around and cross your fingers they let you back in.
4. Even if he sponsors you now while your out of status you will not be stage one approved for seven months and by that time it should be too late.

Sorry for the negative answer but that is the way it currently is. 7-8 months processing time for out of status spousal type sponsorships.

I´m going to give you a reality check and you need to take this very seriously. You´ve been here for "a few years" and you haven´t bothered to file for Permanent Residency? Sorry, but that´s really risky - I´d even say crazy! You would not have been able to continue to renew your visitor status indefinitely - and it´s actually surprising they haven´t tracked you down and deported you! You´re in a very serious situation and you´ve got to get your act together immediately and get your application for Permanent Residency filed. At this point, because of the legislation that went into effect in Feb ´05, you do not have to have legal status in order to apply or be approved for Permanent Residency, however, because you do not have legal status in Canada you will need to file an "outside" application and you will need an address in the States that you can use (family there?). Actually, it´s better for you to file an outside application anyway because it´s much faster (only 4-6 months for approval) where it takes 12-18 months if you file from within Canada. Considering your current medical situation you might be lucky enough to get PR and have yourself covered before the birth of your baby. In the meantime your medical care is going to have to be out of pocket unless some other provisions are available from your Province for the care of foreign nationals. I hate to say it, but you´ve really backed yourself into a corner. So let´s get you out of it!

You mentioned finances were tight and it´s going to be expensive, but YOU DON´T HAVE ANY OTHER OPTION. You´re looking at $550 up front ($75 sponsor fee and $475 applicant fee) that needs to be submitted with the ap. You can defer payment of the $490 Permanent Residency fee until your application is approved and they ask for it, but that will delay your approval - and you need to be approved as soon as possible. So do what you have to to get that money together and don´t let it delay you any longer. Also, it´s very important that you DO NOT LEAVE CANADA for any reason between now and when you´re finally approved. You have "flown in the face" of the requirement that you have status in Canada to be here - as a US citizen you are only allowed to stay in Canada as a visitor for six months, not several years. The likelihood that you will be refused re-entry (and even excluded from Canada) is VERY high and they WILL NOT CARE that you have a husband and a child here, or that you´re pregnant.

Thank you for replying. I´ve started downloading the applications now and am working on them. When you say to apply "outside" Canada is there different applications for this? The link you sent me was for Inside. Also I see that I need a passport? How am I to get one from the US if I can´t go back into the US? I need a medical examination, but I can´t get the xrays because I´m pregnant and do I get that here in Canada since i´m not supposed to leave?

I wasn´t on worker permit or student permit. I was on temporary visa for one year, had a year extension after that and the extension ran out in July of this year. Just to clear that up if it makes any difference.
