Subject: Thank you, Uniden!
  Hi, Uniden:

Thank you very much for your information on mailing address at port of entry.

Could you please help me on another question regarding maintaining PR status? I am not clear about the regulation on how many years are needed to stay in Canada in order to keep PR status. I have found different information on CIC website and in the letter CIC has sent to me. On the website, it says I must stay in Canada for at least 2 out of 5 years in order to keep my PR. But in the letter CIC has sent to me, they say I must stay in Canada for at least 3 out of 5 years to keep the PR status. Do you know which one is correct?

Thank you very much!

Hi,
I am Jeta Hasani. I am 27 years old and I live in Kosova. I am married, I have a daughter. My husband is journalist and he wrote some articles against a political party in Kosova, since then we are not safe here. We would like to emmigrate in Canada. We have both finished the studies here in Kosova. Could someone inform me how can we go in Canada and continue our life in safe place.

Anonymous,

I will look into this today. These are indeed conflicting pieces of information. I will try to find out what exactly is right and corrent.

Could you please copy the phrase from your letter and paste it in here? I am interested in the exact wording. Thanks in advance!

OK all, here is the ultimate answer on how you can maintain Canadian Permanent Resident Status:

Short Answer:
- Reside in Canada for 730 days (2 years) in any 5-year period.

And here is the long answer (an excerpt from CIC´s website @
http://www.cic.gc.ca/english/newcomer/res-oblig.html
Remember folks, whenever you are in doubt, always trust CIC´s words!

Permanent Residence Obligations

Here is what you must do to comply with your residency obligations:

You must accumulate two years of physical presence in Canada in every five-year period.

You can also count Canadian residency days if you are outside Canada for an extended period of time for one of the following reasons:

- You are accompanying your Canadian-citizen spouse or common-law partner.

- You are a child accompanying a Canadian-citizen parent.

- You are employed on a full-time basis by a Canadian business, the Public Service of Canada or the public service of a Canadian province.

- You are accompanying your permanent resident spouse or common-law partner who is also outside Canada and who is employed on a full-time basis by a Canadian business, the Public Service of Canada or the public service of a Canadian province.

- You are a child accompanying a permanent resident parent who is outside Canada and employed on a full-time basis by a Canadian business, the Public Service of Canada or the public service of a Canadian province.

Please note that you are complying with your residency obligations only if:

- your accompanying permanent-resident spouse, common-law partner or parent is complying with their residency obligations; and

- you ordinarily reside with your accompanying Canadian-citizen or permanent-resident spouse, common-law partner or parent.

VERY IMPORTANT: It seems that not only you, but also your accompanying cpouse, common-law partner or parent MUST comply with the above obligations in order for YOU to maintain permanent resident status! Bottom line is: either ALL comply or NOBODY complies!

Anonymous, I still need to analyze the exact wording in the letter you have received along with your PR in order to decide on the correctness of it.. I definitely trust the information on CIC´s website, or contained within their policies and procedures manuals, over almost anything else.

I hope this helped.

hi, Uniden:

Thank you very much for the information!

The exact wording in the letter CIC sent to me along with my visa and CPR is, I quote,´Until you obtain Canadian citizenship, your permanent residence status may be revoked if you are outside Canada for more than 730 days within 5 years, ....´.

I noticed that the CIC website for "Residency Obligations for PR" was last updated on 2002-12-09, but the information in the letter CIC sent to me was last updated in 2003. It was written on the bottom of the letter.

In any case, I do appreciate your help!

Only the letter, as a document template, has last been updated on that date.

I see that the way they formulated their letter is not exactly correct in my opinion:
"outside Canada for more than 730 days" is here clearly NOT the opposite of "inside Canada for less than 730 days", which they probably meant to say.

I discover misspellings in official documents all the time, or ..I would put it this way: I find misspellings and misleading info where I would not expect it. It´s like seeing a sign displaying "Speling Be" :)

Hi, Uniden:

It is indeed confusing and there could also be misspellings. I think I will ask the CIC officers at the port of entry when I land. Thank you again for your kind help.

Best Wishes!
