Subject: Did I commit misrepresentation??
  I need all the help I can get from you guys please ?.

I have an application for Pr (Spousal inland) in process since Feb 2006
The application was transferred to the local office (to review relationship bona fides as per FOSS).

However in August 2006 I applied to renew my status and changed from Study permit to visitor record (Received Oct 18th 2006)

There was only 2 months left in my course and I thought I could go to school (As CIC call centre agreed too!!)

When the local immigration office sent me a letter regarding more documents I went down to the office to ask a question and there the immigration officer assigned for my case wanted to talk to me ?

We sat there and she asked me some questions , and when I wanted to confirm with her that I can go to school she said ?ARE YOU GOING TO SCHOOL ??? I WILL HAVE TO REPORT YOU!!!?

To tell you the truth I chickened out and the word ?report? scared me and I don?t why I said NO, the officer wanted a letter from the school stating start and completion dates.

I got the letter and on there it states the date of completion as Nov 24th , what means I went to school without authorization and I lied to her,.

The second part worries me as I am afraid that my application will be refused for misrepresentation.

The school also received a sharp letter from immigration regarding me and that I am not allowed to be in school.

The latest update is that I received a letter for an interview for me and my spouse at the local office.

What do you think the out come from that will be??!!!

Did I commit misrepresentation, how bad??!!
Do you think the officer will understand that I was scared and I did not mean to lie ??

Please help if u can

Which Immigration office did you walk into without an appointment?

How did you ever get to talk to a officer in person without an appointment especially one that had your file? Are you from a major centre?

I hope you bought a super seven ticket last night it was only 32 million tax free with your luck your sure to win.

You claimed in your posting you lied! Did you misrepresent the facts YES! Answer to your question DID I COMMIT MISREPRESENTATION-----YES.

Is your relationship genuine? Then relax but understand one thing they called you for an interview because something was lacking in your spousal sponsorship application.

Get someone who is very good to put you through a pre marriage interview. Make sure he/she goes over your forms with a fine tooth comb to see if there are any mistakes. Hopefully the both of you have been getting all kinds of mail at your current address. Tons of photos of the two of you laughing and playing together. Non-marriage photos.

Well the office is Hamilton,Ontario

I was surprised that the officer wanted to talk to me too!!!

Our relationship is genuine 100%,We have been living together for the last 2 years married for a year and half...

We sent over 150 pictures between wedding, honey moon, family parties and gatherings, camping tips and all kinds of stuff..

We have been receiving lots of mail lately, but not in both our names, is that OK ??!!!!.

we have sent many letters from family, friends, teachers to support the relationship.

My FOSS notes states that the file was transferred to Hamilton to review bona fides of the relationship.

To tell you the truth my worry now is the misrepresentation..I hope I won´t be hit with it (It was one stupid mistake)

Adam you do have a problem but not insurmountable one. Your mistake was going directly to Hamilton CIC instead of mailing in the documents.

If you applied as an In-Status in Canada spousal applicant and they have written the school they may have already ordered you excluded for misrepresentation or at least written the report. Two years instead of one is for misrepresentation.

Who is your representative or do you have one? He/She needs to intimidate them back.

Worse case scenario is you have to start all over again on a out of status In-Canada spousal sponsorship. Find the operational memo 018 which will help alot in your case. Be sure to resubmit before they offer you a PRRA Pre Removal Risk Assessment or call you in and tell you to bring certain documents and four photos. It has to be submitted to Vegreville before the initial PRRA interview.

Keep me informed would like to know the outcome.

Is there a way to find out if they have written the report to excluded me for misrepresentation ?

I have the interview in few days and from the look of the letter they are asking for documents related to the relationship:
-your sponsor must be present
-your passport
-proof of Canadian citizenship for your sponsor
-marriage certificate
-proof to show that you and your sponsor are co-habited as a married couple
-letters from present and previous employers
-copy of the last files income tax
-any other info.

This was the last letter I received from them and it is after they found out about me attending school without authorization .

Wouldn´t they have sent me a letter for a removal order interview already instead of the spousal interview ??!!!

OK one more question please ...

I received the letter for the interview on Dec 19th 06,and the school received a letter the same day as well...

The officer found out about the non-compliance before writing the spousal interview letter to us.

If the officer wanted to refuse the application for inadmissibility would she still has requested a spousal interview ?? could not she just refuse the application based on misrepresentation without the spousal interview??

I am just hoping that she wants to give us a chance to explain the error..
