Subject: ROY, UNIDEN or SHARON, PLS ANSWER!!!
We got our Canadian PR visa last week. We plan to land at Ontario this summer from the US. My wife is out-of status here in the US for 6 years. I wanna ask you guys if there will be any problem if we exit the US border?. Thanks for all your help.

When you drive across the first official you meet at the border is a Canadian Official CBSA. If you fly in the airline will check your documents and allow you to board and when you Land the first official you see is a Canadian CBSA officer so everything will be fine and come on up.

First of all congratulation to the original poster and welcome to Canada. Please don´t take this personally.

I am curious. Being illegal in USA for complete 6 years, how does/did it go with the security and background check? That is if we exclude misrepresentaion (assuming the spouse was in his/her country of origin during that period)

Can Roy or someone explain this? thanks

It has got nothing to do with misrepresentation but everything to do with regulation 11 and your address part of schedule 1

There are millions of illegals in the USA and CIC knows that. There are approximately 400,000 undocumented workers in Canada and CIC knows that.

So why would anyone lie? If I had been living in another country earning a living abd bot living off that countries welfare system who cares? Not CIC it is a fact of life now.

If you are in the states you need proof of no convictions and the authorites don´t really care because your planning on leaving and it is the reason for the request.

I understand what you are saying. But again my question is: How can someone obtain a security & background checks for a period of 6 years ( and these are essential parts in admisibility process), if this (someone) was not legally documented in that country.???
What you are saying is reality, yes, and it does exist, yes, we all know about it, yes. But you are talking about those hidden sleepy illegal immigrants {who are not immigrating to somewhere else, who are not moving and who avoid by any mean any contact with police and government agents}.

Actually, the whole 6 years is the waiting period from one decision to another. My wife applied for H1B by herself. The problem is that because she didn´t hire any lawyer to process her application, she was denied the first time. So after a couple of appeals with some mistakes from the lawyer´s side, she finally got a letter stating that her appeal is still denied. If she wants to appeal again, she will now go to court not INS. We don´t have any problems with the background and security checks since Im the principal applicant and we stated in our application to CIC that she is out of status here in the US. She doesn´t have any criminal record or watsoever. I just asked the question about landing because of what we read from the previous posts that they find difficulty exiting US border. Thanks for all your info.
