Subject: updating marital status. please advise me.
 

i submitted my application, passed the interview (as a caregiver) when i was single. was not in my plan to get married, but my bf and i got married, then they issued my visa. so all my papers state that im single and never married.

i am to renew my working permit this April. What should i do, how should i inform the cic? should i change my status as married and attach my marriage contract and should i attach letter explaining my misrepresentaion, which is actually letter of confusion when i entered Canada.



please help me. i want to clean up this unexpected mess. i was scared being deported if i declared before at the immigration that i am married, while my papers said im single. u know, lack of knowledge of a foreign country laws and being apprehended to lie. my sincere apology for this.

you won´t get deported, worst comes with worst, you are not allowed to sponsor any partners in future.
your story was very similiar to CTV W5 documentry, it was on TV too...quite a lot of immigrants actually got visa after marriage status changed.

ok, catch for ya, did you finish landing process for your PR visa or not? if not great... , if yes... then, basically you are not allowed to sponsor in lifetime...

Your new spouse and/or children must be added to your application and undergo full processing

you should immediately send to this office:

? a copy of the marriage, divorce, birth or adoption certificate
or
? a letter advising when and where the marriage, divorce, birth or adoption is expected to take
Failure to follow these instructions
? If you fail to follow these instructions you will not be allowed to land in Canada with your family.
? Your file is closed with the issuance of your visa and it cannot be reopened.

Maybe I am asking a stupid question here, in which case I am asking you to excuse my ignorance.., but a caregiver visa is a WORK visa, not an IMMIGRANT visa, right?!?
That would mean that one can update the marital status as it changes (not after 7 years!) without repercussions. Nobody (especially not Shemfan) has mentioned anything about immigrating to Canada, or sponsoring anyone (yet).

Shemfan, always read the small print on anything! Always!
The fact that you do not know the rules and laws of a country is not a plausible excuse for lying.
Should you write a letter to CIC to update your marital status, do not use the word "misrepresentation". Fill out just the needed form(s), or call CIC and ask what you should do, but do not give more than just the absolutely necessary information needed for updating your marital status in CIC´s records. Rule of thumb is to answer if asked, be quiet if you aren´t. Some people mess up big time by saying stuff they should not have said. By the time someone says "Ooops!" it may already be too late..

Someone please correct me if I´m wrong about this.
I am not giving advice or anything like that, just brainstorming..

thank u. im not a PR and have not applied for it yet. thanks anyway for your time here and i´ll just update my marital status then as i renew my working permit soon.

2.what is this SPOUSAL PROGRAM than excempts spouse´ application from HRSDC confirmation if spouse outside canada has a job offer in canada?

Any PR who fails to inform CIC of change in marital status will not be allowed to sponsor their partner if they fail to declare them on their application and this includes children who are not listed.

All dependents have to pass medicals! If you try to sponsor them later they will not be deemed members of the family class because you failed to state that they were family in your application.

Here is the regulation;

117. (1) A foreign national is a member of the family class if, with respect to a sponsor, the foreign national is

(9) A foreign national shall not be considered a member of the family class by virtue of their relationship to a sponsor if

d) subject to subsection (10), the sponsor previously made an application for permanent residence and became a permanent resident and, at the time of that application, the foreign national was a non-accompanying family member of the sponsor and was not examined.

Shemfan is not a PR. Does everything you are listing above also apply to people on (just) work permit? Just wondering..

im not a PR yet. im only a year and a half working here in canada under live in caregiver prog, which means, i only have temporary working visa, which i should renew this coming April so i can work legally for another year or two. In regards renewal, i will update my marital status, and attach the marriage contract as i was advised here. am i right?

i know lots of people dont have the knowledge as u guys have as concerns "immigration", just the same, my big thanks for the clear confirmations of what we are to do with our messes.

you still have a problem. you made and completed an application to CIC (work permit) with false information.

all you can do now is advise them on the work permit renewal application that you have changed your status. Can´t be sure what they will do, but you really don´t have much choice.

Should you choose to apply for permanent status at a later date, your ´mistake´ may be considered misrepresentation and could make you problems... but it is too late to go back now.

Your best option is to tell the truth.

i just called the cic and asked them where could i get the forms in renewing my work permit, and said they will just email it to me. i also asked them if theres a specific form needed in updating marital status. an officer said that i dont need to update it since im not a PR yet and it doesnt appear on the permit anyway. and i can just change everything, include my spouse, if i have to apply for PR once im done with my 24 months work.

what do u think? i need your opinion..thanks

Shemfan you came to Canada as a Live In Care Giver (LICG) and you intend to work for two years out of three and apply for permanent residency under this category, CORRECT?

When you apply to become Landed you will want your husband to join you correct? Then they will see that you lied to CIC and they will find this out from your application.

STOP CALLING THE CALL CENTRE AND TELLING THEM YOUR STATUS CHANGED BECAUSE ALL THEY HAVE TO DO IS PUT AN ENTRY INTO FOSS that you lied AND YOUR IN HUGE TROUBLE.
