Landing - US visa question

Subject: Landing - US visa question
  I will be flying to Ottawa, to complete landing formalities. I will be there for a week. I have an expired US visa but valid I-94, can I re-enter US with it or do I have to get a fresh visa stamped in my passport ? Also, if I do have to get a new visa are there any discussion forms/website I get more information abt this.

Arun,

Renew your visa!

I-94 is only an Arrival/Departure Record (not a visa), and you will surrender your I-94 when you depart the US anyway. If you don´t, it will affect you when you return, ..such as being denied entry into the US.

Your entire situation depends on what kind of US visa you are applying for, and what your (immigration) status was when you left the US.

Arun,

You need to get your visa stamped on your passport as the current one has expired. I-94 will not help as you cannot re-enter with it. (moreover, it will be taken from you upon exit).

I am in same situation...and talked with couple of friends...as long as you have valid I-797 (in case of H-1)... you are good...

Those who plan to visit Canada, Mexico or, in the cases of students and exchange visitors, adjacent islands, may re-enter the U.S. within thirty days on expired visas as long as they possess a valid I-94 form unless they are excluded from automatic revalidation, as noted below

I think Samusa is more appropriate. he can take advantage of Auto Visa Revalidation. If he is currently on H-1, and has expired H-1 stamping in passport, then he can enter into US within 21 days from canada and Mexcixo without new visa. However, he can´t apply for new visa within this period.

But if his expired visa and current status are different, then it won´t work. Like, expired F-1 in passport and current valid H-1 status. Then he must need a new H-1 visa in passport.

All,

First, let me say that everybody is right! :)

..but the difference between me and others, is that I said that, GENERALLY SPEAKING, the I-94 needs to be given to the proper authorities when one leaves the US, while in certain EXCEPTIONAL cases, like the ones you all have mentioned, you can re-enter the US with an expired visa under the automatic revalidation.

As a reminder, Arun hasn´t mentioned the type of (expired) visa (s)he is on, the current immigration status in the US, etc. As long as we do not know these important details, Arun´s case should not be treated as an exception. Guessing about the missing pieces of information is still guessing, and could lead to really bad advice.

With the information that I NOW have, I know that Arun has an expired US visa, and a valid I-94. Since in all but the exceptional cases the I-94 must be surrendered at departure from the US, I recommend that the I-94 be surrendered at departure from the US. Since an expired visa is nothing but an expired visa, I recommend that the visa be renewed. I hope you all agree so far.

Should Arun provide more information, let´s feed that information into the equation and go from there! Let´s not assume anything!
