Subject: Landing and coming back to US
  Hi guys,

Here is the situation

1- I am in US since 2000 on H1-B and my family members are on h4.
2- I have received my landing papers for Canada´s permanent residence.
3- My H1-B is valid but the visa on my passport is expired. I sent it for revalidation during the days the laws were being changed so that Pakistani passport holders are required to go to Pakistan for revalidation. The result was that they put a stamp on my visa that says "Cancelled without prejudice" and asked me to get it validated from Pakistan.
4- I have to land in Canada before April 28, 2007 and need to get back to US.

I have been told that if you are permanent resident in Canada, you can get your H1-B revalidated at US consulate in Canada. My first question is, how valid that information is? I am also told that it takes three weeks to get a PR card in Canada. My second question is, if I go to US consulate for revalidation, do they require you to bring your PR card? My employer is not willing to give me a leave for three weeks and there´s no way I can stay in Canada for three weeks just waiting for the PR card at this time.

Your help to answer the questions will greatly be appreciated.

First of all, Congrats on getting the PR!

When did the law change that you can´t get your visa stamped in Canada if you are a Pakistani without Canadian PR? I know someone who went there last year and got his visa stamped and someone else who is a Canadian PR working in the US who got his stamp as well.

What is the source of your information? When did they put the stamp in your passport telling you to go to Pakistan to get it stamped?

Just go and land in Canada. Make an appointment with the US consulate first and go around that time. Chances are you will get it within a week. The longest waiting time I have heard so far in Canada was 2 months for a couple. Hope and work for the best and leave the result to the Divine.

Yes, Newbie is right. You can take visa from canada as a PR.

I would suggest you to open a bank account with some good balance in Canada. PR means you have to show that you have strong ties in Canada.

Newbie: Thanks. My source of information is an INS officer who told that to me in 2003. I asked him if I could go to Canada on a visit visa and get my visa revalidated. His exact words were "That game has been played for far too long. Its over now" :)

What I need to know at this stage is that whether the US consulate in Canada requires the PR Card to prove that you are a landed immigrant. If not, what other evidence do they require to prove that you are a landed immigrant? Do you get some paper at the time of landing as a proof?

I am sorry to say this, but the INS officer you met was being racist and he was showing his hatred towards you. There is no game!! I even know people on h1 visas in USA who were not canadian residents and went there to get US visa last year. You will be fine. I can´t stress this enough. If you have a clean mind and concious no one can refuse you a visa to any country in the world!
