  To All

When you people hire someone to assist you with an application whether it is an In Land issue or an Overseas application THINK TWICE. The sad fact is that anyone can represent anyone in this business prior to submitting the application as long as they do not make representations to CIC, CBSA or IRB at the time of submission or post submission. UNIDEN See IP9 last paragraph section 2

WHAT YOU ALL SHOULD BE ASKING IS WILL HE/SHE DO A QUALITY JOB ON MY APPLICATION? PLUS, PLUS, PLUS

This week I brought back a failed refugee claimant (DEPORTED) from Portugal with his family on a work permit. Kids got student permits.

This man spoke little English and hired representatives (Consultant) who submitted a refugee claim on his behalf and represented him at a hearing stating that he had a well founded fear of persecution based on there is NO WORK IN PORTUGAL an EU country.

Then he was recommended to file an application for leave to appeal of the negative refugee decision to the Federal court of Canada. Guess what THIS TIME HIS LEGAL COUNSEL LOST!

Then he hired another representative to submit a Humanitarian and Compassionate application on his behalf. The submissions where not quite two pages long and stated that he had family in Canada status believed to be illegal! He had lots of relatives including a sister who is a Canadian citizen. NO UNDERTAKING OF ASSISTANCE SUBMITTED. H&C application refused!

Then they come to me a non Portuguese speaker on recommendation of a few Legal Counsels to do another H&C application which takes four months for Vegreville CPC to even open. We had no time to submit his application because he was called for a PRRA Pre Removal Risk Assessment which considers a Risk to Life of new evidence from the time the person lost their refugee claim until CBSA/CIC gets ready to remove the person.

Well there is still high unemployment in Portugal but what could I say? is that a risk to his life....... I lost that application.

In the mean time I had gotten HRSDC approval and was ready to submit an application but waited five months after he returned to Portugal. His wife was pregnent when she left and after the baby was born we submitted. It took about three months from the time Paris Visa Post started working on the file for them to return Monday on valid temporary permits.

ALL APPLICANTS HAVE A RESPONSIBILITY TO RESEARCH WHOM THEY ARE GOING TO RETAIN. ALL REPRESENTATIVES HAVE AN OBLIGATION TO DO THE WORK THEY ARE RETAINED TO DO.

This is my morning rant!

On last Friday CBC News Toronto did a piece and showed me on TV mispelled my family name and called me a Lawyer, which I am not.
I am a member of the Canadian Society of Immigration Consultants CSIC and therefore authorized to represent applicants at hearings and infront of CIC, CBSA and the seperate parts of the IRB.

I received several complaints because (CBC is the National TV & Radio) CBC News Toronto labelled me incorrectly as a Lawyer. The complaints came from fellow members a.k.a Immigration Consultants NOT Lawyers!!!! When the CSIC Senior Investigator called luckily I was on CBC Radio stating I am an Immigration Consultant.

We met the family with about five TV crews later Monday and several newspapers and the family was hugging and kissing me and where so happy to be back. I NOR HIS FAMILY IN CANADA DID NOT INVITE THE MEDIA TO BE AT THE AIRPORT.

Then on Tuesday a Newspaper article came out quoting another Immigration Consultant but not in his capacity as an authorized representative but as a President of a Portuguse Association. It was never mentioned in the article that the person claiming many Portuguese that where removed last March 2006 have already returned was another consultant. This person claimed 80% of those Portuguese removed are either back or in the process of being back. That comment took the wind out of my sails so to speak.

Then I thought I had never seen media reports about Portuguese deportees returning and if other representatives had gotten so many back why had the media not covered it? Then I thought some more since we waited for my client to give birth was all the other persons removed less pregnent then my client when she left on April 1st?

Then yesterday while being at various enforcement offices and speaking to staff of CIC, GTEC, CBSA & the IRB they all said they knew of NO other deported Portuguese personS being authorized to return on a Work Permit. Maybe those government employees are lacking knowledge----------

THE CBSA/CIC STAFF I SPOKE WITH ALL WANTED TO KNOW WHAT MY MAGIC TOUCH WAS TO ACCOMPLISH GETTING A DEPORTED PERSON A MINISTERS CONSENCT TO RETURN AFTER COMING AS A VISITOR THEN MAKING A REFUGEE CLAIM.

I STATED ALL I DID WAS INFORM THE PARIS VISA POST THAT I DO NOT SPEAK PORTUGUESE NOR DO ANY OF MY STAFF AND THAT I NEVER RECOMMENDED ANY APPLICATION THAT MY CLIENT SUBMITTED WHILE IN CANADA.

PLEASE, Pick the best representative you can find IF you feel it necessary to hire someone. Just because they can speak your language does not make them incompetent and just because they can not speak your language does not make them a quality representative.

NOW I HAVE BEEN TOLD BY SOME AUTHORIZED REPRESENTATIVES THAT I SHOULD NOT ANSWER YOUR QUESTIONS HERE. I KNOW THAT SOMETIMES CERTAIN PEOPLE WHO MAY BE IN THIS BUISINESS HAVE POSTED A QUESTION AND THEN ANSWERED IT HOPING TO GET THE CREDIT. I THINK SOME QUESTIONS ADDRESSED TO ME ARE ATTEMPTS TO GET ME INTO TROUBLE.

MY QUESTION IS FOR MY SAFETY AND MY FAMILY SAKE/BUSINESS ETC. SHOULD I STOP ANSWERING YOUR QUESTIONS???????????????????????????????????????

Roy,

I fully understand your position, and also understand that sometimes you feel like you are between a rock and a hard place. Helping others is something that people with a REAL intention to help can do best, and you certainly are one of them.

As a reader of this forum, and as someone who occasionally asks questions, I will always look forward to your quality answers. Should you disappear one day, I will know how to get a hold of you, your website is bookmarked! There is no real escape! :)

As a friend giving honest advice to another friend, I would tell you that YOU are the only person who knows what is worth and what is not worth doing. Who knows your priorities better than you?!? Nobody! Look at your rewards for sharing your knowledge with us.. for free`.. Is there a reward for you (I am not talking about money, but probably about the same type of "reward" I get when I answer other people´s questions)?

As a person who also works hard for a living, I can give you another piece of advice, that may help you out of your dilemma regarding the "Freebie or not freebie question":
Try to determine the level of difficulty for providing the answer to an immigration-related question. Let´s say that on a scale from 1-10 an easy answer corresponds to ´1´ and an extremely difficult one is the equivalent of a ´10´. Decide to answer all ´easy´ questions, let´s say level 1-5 for free, while providing the others for an appropriate fee. Reply to an interested party by saying that you do have the answer, and that you can provide it, but it is not for free. This way, while you identify the person you are dealing with, you can also potentially deter your competitors from trying to get an answer from you.. and later get the credit for it.

It took you such a long time to gain your knowledge, and your expertise is worth something to many people. Learn how to sell your expertise, while also providing some free ´1-5´s :)
Roy, I have told you before, I wouldn´t mind paying for good immigration advice, and I know I am not the only one thinking like that. I appreciate freebies, but I do not take anything for granted!

On a different note, I am glad to hear about your recent successes. Maybe TV and radio exposure is exactly what you need for promoting your immigration consulting business.

I am with Uniden on this one. You worked hard for the knowledge you have. If it is clearly in the manuals - share it. If it is interpretation of the manuals and knowing how to use them- let people take your advise off this board and pay you a return on your intellectual investment.

I have to be agree with Uniden and Sharon. This is what you do for living and there are people out there that are abusing of your help.

I really really enjoy your comments as a matter of fact I have learned a lot my self but it is completly understandable that people should pay for a professional advice.

I am a professional (not a lawyer or Immigration consul.)and a person starts paying the minute they call me for a professional solution.
It is just the nature of the beast.

I hope to see you on the ocean some day...you old sailor!

I agree with Uniden, Sharon and Bill. Well, the point is you are not a magician that only give advices because you just want to be famous. You earned it! How many years you went to school, 17, 18, 19, 20+ years and every single day you´re still learning. So, just continue what you´re doing and God bless you for that.

I learned a lot from you guys and I thank all of you.
