Subject: U.S Citizen in Canada without status
  Hi, I am a Canadian citizen married to a U.S citizen. My husband came to Canada in May of 2006, we had our daughter in Aug 2006. He remained in Canada afterwards and we planned on getting his PR done.. We were waiting on fingerprints from the U.S so we could start the paperwork, until recently we became aware that he was able to get them done here in Canada.. I am wondering if him being in Canada all this time without having any Canadian status can lead to him being deported or his application being denied. He has no criminal record(I heard that could cause him to be deported). He was in Law Enforcement in the U.S and was wondering is there is such a work visa in this field. We are so confused about this whole immigration situation and it makes it that much more difficult because we have a young child together and it would be heart breaking to see him have to leave us. They should make people more aware of the rules and options, but instead it seems they make it so difficult and costly.

Technically the spousal sponsorship should be submitted (outside Canada) in the states. The results are far quicker and it is the route CIC wants both of you to take. Approximate time frame six months from beginning to end. What you need to be careful about is the address section of the schedule 1 form. Non seperation is possible.

You can also submit an in Canada application regardless of status but if they kick your application for an interview it could easily be well more then a year before he is elligable for a work permit let alone Permanent resident status.

Thank you kindly for the info.. We are less concerned with him being able to work , we just dont want to have this haunt us later or for him to be forced back the U.S. So he can remain here in Canada until the PR is completed and not be penilized?

If Dad is contributing to your standard of living I can understand that he would be reluctant from being away from the two of you.

What did you mean by the address section of the schedule 1 form. Non seperation is possible? Sorry I am unfamilar with all of this, and I greatly appreciate your time and info. So basically it wont be a big deal that he has been here for 8 months with no canadian status, and that wont effect us when it comes time to process the sponsorship application, thanks again Roy

Interpretation is what we all do. Three people served a meal could interpret the meal the following way 1 Super 2. nothing special 3. YUK!

A visitor is someone for a hour, minute, month three months or?????

I suggest that you submit the application outside of Canada it will be better for all of you concerned.

Yes it´s probably going to be faster, however it just seems like a long time for him to be away from us for. I have never been so stressed over something as I am with this whole ordeal. Our main concern is weither he is doing wrong by staying this long. I have contaced lawyers and thet said he is allowed to remain in Canada until the process is complete. We plan to start with the paperwork this month so I hope it all goes well, thank you kindly for your time and advice Roy,
