  First, the facts people :

Name: CastAway
Date of Birth : 1971
Marital Status : single
Citizenship Status : Foreign National
Family Citizenship Status : Father, sister and brother Canadian citizens. Mother (Canadian PR accompanying Canadian husband abroad).

CastAway?s timeline in Canada :

1) 1974 - 1980
(CastAway arrived as landed immigrant in 1974 (age 3). Left Canada in 1980 accompanying parents abroad)

2) 1984 - 1991
(CastAway back living in Canada in 84. Dad becomes Canadian citizen in 1986. CastAway leaves Canada in 1991 at the age of 19 (dependant)accompanying parents abroad...again)

3) 1998 (spent 4 months in Canada on visitor Visa - Inquired with CIS about possible claims to citizenship or PR status after being told he might have a claim by customs officer at point of entry. No claims possible. Proceeded to leave Canada.)

4) 2006 (In Sep 2006 Canadian Embassy denied him vistor visa to attend sister?s wedding on condition that he sign waiver of " Right to Appeal Residency Status Determination". CastAway signed waiver. Visa was extended. Spent 3 weeks in Canada Sept 2006.

Question :

1) Can Castaway have his PR status reinstated through an appeal ?
2) Must he re-apply for PR Visa from abroad ? If so, does he have a good shot at getting it considering he had fulfilled Citizenship requirements many times over before leaving in 1991 ?

you have been told on 3 separate occassions to get professional help. You are asking the same question you did 4 months ago - which would suggest one of two things... you do not follow advice very well or your are a troll.

Just getting as many "second opinions" as possible Sharon. Relax. I?m going to have to start forking over a ton of c notes to a lawyer pretty soon, so I need to know where I stand. Anyway, you don?t have to post if you don?t want to.

do you honestly think there is anyone here that has enough experience in this specific area of citizenship law that you could rely on their answer NO- perhaps with the exception of Roy. So... if you want an answer that has any validity - give Roy a call and have your credit card ready.

I contacted the world renowned immigration attorney Mr. C. Karas. He works out of Toronto. Have you guys heard of him ? He?s supposed to be the best in the business (he even managed to get the Nazi Gold back to the Holocaust victims).

Hi there everyone !

I want to thank all of you for your advice. I also want to tell you that I recieved my Canadian PR visa last month :) It was a long process for me which began not much after I started posting on this thread. I want to especially thank Roy and Sharon for their invaluable help.
