Subject: marry in the US or Canada? working after the fact
  Hello;

This is a two part question; here is some background information first.
I am a canadian citizen currently visiting my boyfriend in the US. We want to move back to Canada because the economy is much better there for his type of work.

Questions:

1.) Would it be better for us to marry in the States or in Canada?
2.) Once we get to Canada, what steps do we take for him to be able to work?
3.) If we should get married in Canada, what would he say when he gets to the Canadian border? just that he is visiting a friend?
4.) I have to leave the US by May because my time will be up so is there anything we should be applying for while we are here?

You can get married in the US or Canada. However processing times for a Permanent resident application (family members) are faster if he applies from outside of Canada.

Once you get married you can go back to Canada, apply for sponsorship and once you are approve as an sponsor, he may apply for a permanent resident status.

If he enters Canada as a visitor and you guys get married, he may apply from in Canada also as Permanent resident. The down side of doing this is that he won´t be able to work in about 8 months and if his application is refused you won´t have any right to appeal it.

It is safer to apply from outside of Canada.

Thanks for your help Bill. Now here is another question for you. He already has a job offer in Canada. So will this automatically give him entry into Canada? or is there more involved?

No, there is a little more complicated than that.

He would need to apply for a work permit in order to work in Canada. He must apply for this permit from abroad.

Except:
Once you get married and you are approved as an sponsor CIC will start processing his application and in some point in time he will get a letter that states that he has been " approved in principle" then he will be able to apply for a work permit from within Canada while CIC is processing his permanent resident application.

Thanks again Bill for all your help! I have not received this much help from anyone since I started this ordeal and I am registered on many forums.
I have yet another question if you could answer I would sure appreciate it!
So it is better if we marry in the States. The problem with that is I have to leave before we could get this done due to the 6 month allowed visit. Do you know what visa I would or could apply for to extend my visit? If I can apply for such a visa, what would my reason be to stay longer? that I wanted to get married?

K,

Well I am not familiar with the US Immigration law about how to get an extention as a visitor.

However, he may enter Canada as a visitor (as an american citizen a visitor visa is not requeried to enter Canada as a turist, valid US Passport is enough).

He would have to proof at the port of entry that he is visiting Canada on temporary basis, he might have to show a return ticket and any proof that he will leave Canada at the end of his visit.

Once he is authorized to enter Canada, he may stay in Canada for 6 months. If you guys get married, make sure that you take lots of pics, specially casual pics. Not always wearing fancy clothes.

He can return to the US and then YOU, from within Canada can start the process for sponsorship and PR while he is in the US.

In some point in time the Case processing centre in Canada will forward his PR application (once you are approved as sponsor) to the local Canadian Embassy in charge of his region for further processing.

If his visa gets approved, he will received the magic letter called "Passport request" and his Immigrant visa and landing documents will be given to him to enter Canada as a PR.

The process from abroad is faster and safer.
