Subject: Background check
  Hi All,
My Brother-in-Law and sister have applied for permanent residency in Canada. As part of the process since my brother in law lived in the USA for a few years they have requested a background clearance certificate from FBI. Now the thing is they have been sent an email dated Feb 15, 2007 informing that they have to submit the clearance certificate in 60 days from that date, else their application will be canceled. But it takes 120 days in average for the FBI to give such a clearance. So, my questions are:

1) Do the Canadian Immigration authorities comply with these kinds of requests to push the dead-lines they set or are theres no way that´s happening?

2)If they do comply with such requests, should we just send such a request ourselves or is this matter too complicated and we need to hire a lawyer.

finally i got (in reply to: Background check)
need to send the canadian consulate about the delay in the clearance and usually they extend it for you. that is what happened with me last month. where they told me that they exstending the 60 days until i get it from the FBI. I did call the FBI and been told that they just mailed it to me. 4 days later i recieved it and sent it to the consulate, a week later (today) i recieved the request for the passports (after 71 months of background check!!!yes 71 months)

Relax! CIC knows that it could take longer than 60 days.

You can do any or both of following things. I recommend you do both:

a) When you request background check from FBI, write your deadline on envelope AND on the cover letter, as advised by FBI/CJIC.

b) Write short letter to CIC, informing them WHEN you have submitted your FBI record request, and what the expected turnaround time is, according to FBI´s website (2 minutes ago it still showed 16-18 weeks). Nothing more, nothing less. Don´t forget to include file# on cover letter and envelope sent to CIC!

Thanks all for replying. It does alleviate some of my worries. Does it really take 71 months to get this clearance from FBI? Thats really disheartening news. Is there any way to speed this up?

"71 months" was not for referring to FBI, but to a "background check", which is done by CIC, not by you. I don´t know the country "Anonymous" is from, but background checks for citizens from certain countries seem to take forever, though 71 months seems HUUUUUUUUUUUUUGE!! FBI is done in maybe 71 days :) I got mine in just less 2 months without mentioning deadlines and all that, simply because I didn´t know about that back then. I am about to update my FBI clearance ahead of CIC asking me to do that, because I am approaching my AOR´s 1-year anniversary.. and this time I will do it right. Probably next week I´ll submit my prints again and keep everyone posted on my progress regarding FBI.

YES, read my initial advice (a), and you will likely be rewarded with faster FBI processing IF you write the deadline on cover letter AND envelope. If your CIC deadline is 60 days, write your deadline to be in 50 days from now.
If you have already sent your prints to FBI there not much you can do, ..but wait ..and inform CIC of a potential delay, as I said in my advice (b).
