Subject: COMMON LAW QUESTION
  hi guys
thanks for all your help so far...i have another question which i have phrased earlier on...but want to get a more detailed answer...

Now me and my common law partner applied for PR and just got it...
though we have recently split up and she does not want to accomany me to canada..as she is doing well where she is...my PR landing is at the end of this month...
Are there any adverse consequences if i land without her and tell the immigration officer that we recently split up and she is not going to be accompaning me...?...
Would CIC think otherwise that i did not inform them...as this happened very recently and we had already got our landing papers..
any advice?

The Principle Applicant must land first whom ever that is. If your not the principle applicant you will not be granted landing.

If the seperation was clean and smooth your partner may have not informed CIC of the change in marital status BUT if your partner is angry with you and has informed Immigration of changes in your relationship you will not be Landed for misrepressentation.

When you Land and you do not inform CIC of your change in marital status which you signed a declaration to do the following could happen.

When and IF CIC finds out by a poison pen letter etc. they could send you to an admissability hearing where you could be ordered removed. Since at that time you would be a PR of Canada you would have a right of appeal.

i am the PRINCIPAL APPLICANT...its just that me and my EX still went ahead and got the visas stamped on our passports...now she just doesnt want to accompany me to canada...i am actually landing end of this month...
so if i land and they ask me why she isnt accompanying me...i want to tell them that we recently seperated and it was too late to inform CIC about this as our visas had already come thru...

MY question was will i get into trouble still...as i still have 2 weeks from now to shoot an email or fax to CIC informing them that my EX common law isnt going to be abel to make it...or i could tell them that when i land...any advice?????

It depends on your interpretation of "seperation" if it is final in your interpretation then you should do something but if there is a small chance of reconcilliation then keep quiet. The issue is did you need her points to make your approval or not?

Things sometimes go back the way they are in a relationship when distance makes the heart grow fonder. It is your call so make the choice, yourself.

no i did not need her points at all...in fact i have a brother who is a canadian resident already...plus i have a decent amount of experiance and i am just 30 years old...when i applied for her it was with the intention of one day moving there togeather...but as human conditions go...things do not work out always...even though we are very good and close friends and i still consider her family...she did contemplate trying to make it before the deadline...but she has a new job alas which does not allow her any leave time...i just want to know if i tell them she couldnt make it bcoz of deadline and work commitments...and her visa expires...can they still come and ask me how come she never followed you to canada...whats the recourse then?...just tell them it didnt work out long distance...also can i reaaply for her while i am there in canada...if she still does decide to chuck it all and join me(wishful thinking but...)
