Subject: Court-Approved Legal Notice from CIC
  sharon, recently, many people received Court-Approved Legal Notice from Citizenship and Immigration Canada,you can refer to http://www.cic.gc.ca/english/mandamus/notice.html for details. I´m a little puzzled because I don´t think that timeframes in settlement agreement favor us a lot. Would you please analyse the advantages and disadvantages for us in case of choosing "opt-out". thanks a million.

this is tough because I am trying to figure it out like everyone else.

You have received a notice because you fall into the time frame that is in dispute. You applied under the old rules. Some of those people have qualified under the new rules as well and have had their files approved, etc. They did not lose any time.

There was a court action mounted that said it was unfair to accept applications and then change the rules in mid stream. So now the government is agreeing to a way that would solve this problem. I suspect there are hundreds of files that are on hold because they qualify under old rules but not the new ones. The proposal is saying that you have a choice if you are still awaiting an initial assessment - they will consider your file under the old rules if you drop all future claim against the government. If you want to seek justice on your own - that mean you opt out of the settlement offer. If you accept what they are offering - then there is no need to respond to any letter. However, the thing that is getting everyone so distressed is the processing times that they are suggesting. Right now there is not one embassy that will guarantee when you will have your exact answer. Part of the settlement is the absolutely latest date you will have a final answer about your file.

As you probably know, some embassies have 4 years of applications in the Q... others have none. In some cases, there might be no old format applications left at all. The government is covering themselves with these dates.

I do not know what to suggest to you. There is a thread somewhere on this website where I posted a letter with some contact numbers for the lawyers involved. They may be able to offer you a better understanding than I can. I just keep reading and reading and hope the muddy water will become clear. I am not there yet- I don´t think anyone is.

if you read between the gobblety goop you can see who is actually affected by this settlement offer (it is still an offer - not a done deal. we will not know if this deal is going to fly until mid March). I wish they could have found a different way to explain it to people in mid process. Happy reading.
