Subject: Questions I have before I get Married..
  My boyfriend of 8 years is American and lives in Seattle and I am Canadian and live in Vancouver, BC. We are planning to get married in Canada as we have agreed that Vancouver is the best place to live. Since we can´t put in the paperwork until after we get married, will they hassel him at the border when he tells them that we is coming into Canada for his wedding ceremoney?

After we submit the application, is he not allowed to cross the border back and forth between Canada and the US? We live an 1.5 hour away from eachother so we currently alternate seeing eachother.

Is he allowed to move to Canada once we are married but before the application is sent? I know that he is not allowed to work while this is all going through, roughly how long would this be?

Hello there, I got married here in Edmonton, my husband has a PR from USA and he was allow to come for the ceremony no questions ask, your husband to be will be allow to come back and forth only if you applied outside Canada, meaning that he will stay in USA during the application process, that´s what I´m doing, ´cause my husband does not want to wait here without going to work or school. I hope this answer some of your questions. Goodluck

I´m US also, staying in Canada with my sponsor/husband while my outside ap is being processed. What Marisol says is true - but she didn´t add that it is possible for your husband to stay with you in Canada while his outside application is being assessed, as long as he keeps his visitor status valid. But he would not be able to work or go to school. Outside applications are processed for US citizen through Buffalo and are currently taking from 4-6 months. As far as whether your fiance will be hassled when coming in to Canada for your wedding ceremony - if he says he´s entering to get married it will all depend on the mood of the IO he encounters at the border. It´s probably best that he keep it simple and say what he always does - that he´s coming in for another visit. Sounds like the two of you are already well-versed in transversing that border, so do what´s always worked. Do not give the IO reason to believe that your husband-to-be thinks that simply by marrying you he suddenly has a right to "move" to Canada. One guy I read about did that - came up two weeks before the wedding bringing some of his stuff. They turned him around and excluded him from Canada for two years. You have to be careful.

After you´re married, if he wants to stay in Canada with you while the ap is being assessed, you approach things a bit differently. You first need to wait until you have a certified copy of your marriage license (you have to order this through the Registrar General´s office) and then both of you go to (or meet in) the States and re-enter Canada together. You (as the Canadian) need to show the proof that you´ve legally married this man, and you need to state your intention to sponsor him for PR. (Note he still does not get to bring in his stuff.) In your favour they should issue him a Visitor Record good for six months to one year. This only allows him to stay in Canada with you - not work, go to school, get healthcare, etc. If he leaves before he gets PR, he will have to go through the whole scenario again on re-entry. But none of this applies if he intends to remain in the States with a job, etc., until he has PR, and only comes to visit you on weekends or whatever. If that´s the case it´s business as usual, even though you´ve married. Hope this helps.

I am curious about this as I am in the same situation. Why do they have to go to the States and then re-enter Canada together? I thought that your spouse could "wait" in Canada for their PR status under the new law? Now I am totally confused as to what to do.

My fiance and I are facing the opposite. I am Canadian wishing to move to the states. We have been together for almost 4 years. I do not have a canadian passport yet, which I realize is a necessary first step. I was temporarily laid off from my job in Canada, but it was only for a month, and then I have work again. I have spent two weeks in the states so far, and I am getting my ducks in order to go back to Canada to file my taxes for this year(my work finally sent my T-4), and to get my passport application signed by my guarantor. After that I do not have to start work again until June first. A letter from my work will state that fact. I have been told that after we file and (hopefully)get approved for a fiancee visa that going back and forth between the two countries is going to be difficult for both of us. I live in Vancouver, and he lives in Seattle. Any answers or suggestions that anyone has is greatly appreciated.
