Subject: dependant children ? Roy please help
  hoping someone can help.Have completed medicals,sent updated police records and paid fee to cic london ,thought i would be getting passport requests,instead get a letter asking why i did not put 2 dependant children on IMM08 form but put them on additional family form and cic london have requested birth certificates and photos for same ? My question is this if i send a notarised declaration stating that they will not be accompanying me now or in the future and if they wish to immigrate to canada they have to under their own rights will they waive these medicals . (they are from a previous marriage,ages 18 and 21 and are in good health)

GOOD QUESTION

They should do the medical but if you sign an affidavit that the former spouse or they refuse to HAVE medicals they will exclude the former dependents from ever receiving 5 additional points because your a PR.

That is if that is the scenario you face.

You cannot just decide to exclude them - it is REQUIRED that you include them as sponsored dependents, whether they ever intend to come to Canada or not. Everybody else has to do this - I have three kids (two are 18 and 20 and not accompanying) and I had to pay almost $1000 for medicals and jump through hoops to get criminal clearances for them. Add to that the fact that my just turned 18 yr old got arrested and will now, most likely, be deemed inadmissable - which also deems me inadmissable - unless I agree to drop him from my application. The thought of having to tell him he can´t come be with me if he needs to breaks my heart. But Roy is right, you can sign an affidavit stating that they refuse the medicals (they are both over 18 and legal adults so your ex-spouse not allowing doesn´t matter anymore) - but it could delay your application indefinitely if CIC decides to try to compel them to be examined anyway. The regulations say you cannot just decide you don´t want them to submit to an examination. Regardless, taking this route means you will forfeit your right to ever bring them to Canada, not just their right to receive 5 lousy points because of your PR. It can be a big pain to get the medicals and the clearances done - but I´d happily do that, and pay the extra fees, and whatever else it might take now (after the arrest) to have even an OPTION to protect my son´s right to come to Canada in the future if he needed me. IMHO, that´s what a parent does.
