I am a permanant resident and my mother got her visit visa in january, and she had a plan to join me in jauary but two weeks ago my dad died and now she is going to join me in few days. She has nobody left in back home and i was wondering if how should i apply her case for Permanant residence as in canada applicant. I am married with 3 kids and my yearly income is $35000.00. Please advise.

Get Mom to Canada as a visitor and together weigh your options.
You seriously need to read carefully this site. www.sponsoryourparents.ca and check your Mothers visa post processing times.
Then go to the CIC site www.cic.gc.ca and check what the government says is the processing times for the same visa post where your mother would have to apply if you submitted your application outside of Canada. WHY THE DIFFERENCE IN TIMES?
BUT there is always a but....There is another option you can apply from within Canada based on Humanitarian and Compassionate (H&C) grounds. You also need to read the Policy and Program manuals for H&C applications. http://www.cic.gc.ca/manuals-guides/english/ip/ip05e.pdf
Section 5.1, 5.24, 6.7, 6.8 etc are some of the key sections.
The key to these types of applications is that the onus is on your Mother to prove that she has an unusual and undeserved hardship not anticpated by the act and in most cases beyond her control and fault.
It is not difficult! You need to research what were the objectives of the CURRENT act when it was being created the governments response etc. etc. Most of the key sections that relate to your Mothers situation can be found on the sponsor your parents web site. Especially IRPA 3 (1) (f) PROMPT PROCESSING.
ALWAYS REMEMBER ---- COMPASSION IS COMMON SENSE!!!!
Who would pay a furniture store a thousand dollars for a sofa and chair and wait 29 months for their PROMPT delivery?
ANY SUBMISSIONS MUST BE SUPPORTED BY DOCUMENTATION AND BE AROUND FORTY PAGES. TRY GOING TO A DOCTOR TO GET A REPORT OF JUST HOW DEVASTATED YOU WOULD BE IF MOTHER HAD TO RETURN HOME AND LIVE THERE ALL BY HERSELF.
