Subject: Skilled worker - immigration from US
  I am native of Slovakia and have graduated from college in US. I am interested in immigration to Canada and wondering if I should start the whole process all by myself or is it worth to have help from a lawyer?

I have a solid F1 status but my spouse overstated her visas. Would this play a role in the process if I am the main applicant?

The issue is which type of application would you be filing?

The super fastest is to come in on a work permit and then apply for PR status as a SW PNP based on an offer of full time employment but you have to show an intent to reside in the province that selects you. Unless your a super duper future employee no employer will wait eight months average for you to arrive as a PNP SW.

Applying as a Federal SW through Buffalo RPC should take about two years.

Lawyers are not required to take one couse in Immigration Law while in Law School and unless they have lots of experience learn at the clients expense. Most SW applications can be completed with few problems if you just take your time.

Regarding your spouse being out of status it is not a big problem and does not make you inadmissable to Canada. As long as you were legally entered for one year you can apply in Buffalo but check out processing times for Vienna.
