Subject: strange situation :) need advice asap
  HI all, mi hoing there is someone out there who can help us or at least point us in the right direction.

the story goes (sorry if it is a bit long)...

my partner, myself and our 2 yr old son are all australian citizens. My partner howevrer has been working in the USA for the past 2 yrs whilst my son and i have majority of the time remained in australia (we took a few trips to the states for 3 mth visits) as we are not married and obtaining a visa was a bit difficult ... (in australia we have what is called a defacto marriage and as such are treated as a married couple).

Anyway... my partners job in the USA is coming to an end and he has been offered a job in Canada... we are very excited about this and obviously we all want to go and be together this time... im assuming my partner will be on some type of perm working visa as his contract is 2 years initially).

so i guess im wondering, is it possible for us to move together as defacto´s or will we need to get married before hand ect?...

Canada recognises "common-law" BUT you have to have been living together for 12 consecutive months to qualify. I assume you will have to get married.

All they (whom ever assisted him) have to do was to list you on the overseas work permit when he applied. Has he applied? See http://www.cic.gc.ca/english/pdf/kits/forms/IMM1295B.PDF and if you want to ensure fill in the IMM 5409 to prove your union.

Not complicated.
