Subject: HELP!! CSIC consultant doubt
  Hi, my immigration consoultant has a Full Membership Certificate under the glass of his table. I assumed he passed the membership exam and never really doubted about this until today I happened to visit the CSIC (canadian society of immigrationn consultants) and was surprised to find out his name is not on the membership list but on the REVOKED membership list. The reason of his membership getting revoked is "full membership criteria not met". I remember he said he passed the exam on Sept 2006, and the revoke date on the website says Nov, 2006. How could his membership get revoked just two months after? What might be the detailed reason for the revoke? I´m worried about my immigration process right now. I call CSIC but I was directed from voicemail to voicemail........Someone please help! Thanks a lot in advance.

As most of you know I´m not shy. So I will answer this posting. It is probably a trap to get me into trouble but here goes. Hopefully if I get into big trouble some of you readers will come to my assistance.

No one knows for sure WHY the person got revoked but there are many reasons why this persons membership was revoked.

If you read the Immigration Policy and Program Manuals InLand Processing IP9 manuals Section 2 you might understand one reason. ANY PERSON CAN ADVISE ON IMMIGRATION MATTERS AS LONG AS THEY GET PAID PRIOR TO THE APPLICANT SUBMITTING HIS/HER APPLICATION. http://www.cic.gc.ca/manuals-guides/english/ip/ip09e.pdf

As you have read the Immigration Division, Immigration Appeal Division, Immigration and Refugee Board, Canada Border Service Agency and Citizenship and Immigration interpret the regulations to mean representation at the time of submission or post submission or in front of an officer or at a hearing. REAL CONSUMER PROTECTION?

When certain people came up with the "good" idea of regulating consultants there were 6000 consultants. Now there are approximately one thousand Full Members of CSIC. Of that one thousand almost half are students who have just graduated from some Immigration Consultant course. If you go to the web site www.csic.ca you will see time and again regarding Law Suit after Law suit. Why so many and still more coming up???? Some people do not see eye to eye with the regulators.

There are comments on the blog regarding the only consultant suspended """"NOT"""" for non payment of membership fees or for not meeting the membership requirements.

Many Consultants including myself found it difficult to pass the language requirements due to be setting quite high. Some passed the language and not the Full Membership exam.

Some who only do overseas immigration can hide within the Policy and Program Manuals IP9 section 2 and do not see a reason to pay such high membership fees. Some only do spousal applications inside and out of Canada with the odd PRRA & H&C applications so they never go infront of members of the IAD or IRB so they see no reason to be members.

Others became frustrated with what some see as a money grab and no support from the society. Money for this money for that, money for this and the web site is an issue as well.

One consultant told me he can go see Donald Trump, Tony Robbins etc. etc. this weekend in Toronto for $99.00 at the Learning Annex but CSIC wants $800.00 or $900.00 for a two day event. The event is held on a weekend when my potential clients (the ones with money) have time to see me. I really can not afford two days in a row off.

CSIC refused to allow me to be a presenter at this CPD event. I assume that they find me ignorant regarding Immigration issues. Maybe because I have not always been FULLY COMMITTED to the Society. Maybe because others are better? You tell me!

YESTERDAY I DID A SPOUSAL APPEAL FOR A MAN MARRIED TO A FOREIGN NATIONAL IN CHINA. HIS SPONSORSHIP WAS REFUSED BY THE VISA POST BECAUSE OF TWO OR THREE MINOR MISTAKES ON THE FORMS.

IF YOU SUBMIT THE APPLICATION YOURSELF OR YOU PAY AN UNAUTHORIZED OR AUTHORIZED REPRESENTATIVE ALWAYS CHECK OVER THE FORMS WITH A FINE TOOTH COMB BEFORE SUBMITTING ANY APPLICATION!

I am a member of CSIC because I like to do appeals, detention reviews and it makes it easier for me to fight them tooth and nail for the sake of my clients.

UNDERSTAND THIS VERY CLEAR! LAWYERS ARE NOT REQUIRED TO TAKE ANY SUBJECTS IN IMMIGRATION LAW WHILE IN LAW SCHOOL AND LEARN LIKE CHILDREN FROM MISTAKES.

SOME OF YOU CAN DO YOUR APPLICATIONS YOURSELF GOOD LUCK TO YOU BUT IF YOU RUN INTO TROUBLE THINK TWICE ABOUT WHOM YOU PAY TO ASSIST YOU.

Hi Roy,

Thanks for your message. That´s quite a lot words and I need some time to digest them. Thanks again; that was really of big help.

One thing I noteced on the CSIC website´s revoked membership list was that on the SAME DAY so many memberships were revoked. I guess this date was when the board made the decision to cancel their membership, or could anything happen to all of them on the same day, for maybe various reasons? What do you think the reason would be? I´ll read your post again to learn more. Thank you very much.

When one quits a job they quit a job.

Sometimes when one quits employers need to put their own spin on that so the company four months later record that they fired the employee.

It just might be possible that some 800 consultants choosed not to write the full membership or language exams and decided to no longer comply with CSIC´s requirement for full membership.

So one could say they quit and others can say you did not comply so we are going to revoke your membership. Or one quits a job and after the person quits they get fired??????

Ask yourself this question if so many quit or were revoked by the society why is there so few having an intention to resign? COULD THEY BE ANGRY?

Maybe because when you quit your former employer has NO control over you. How can you revoke membership then tell former members they must transfer files etc. etc.

Just a question.

Thanks, Roy. That makes good sense, but why did so many consultants choose to join CSIC on the first hand if later they all chose not to write the exam? If that many consultants chose not to take the exam, what´s the point of the existence of CSIC and why would Immigration still trust the lawyers´ qualifications (or do they not care)? That´s why I guess there must be some objective reason.
