Subject: Sposal sponsorship
I am a recently married canadian citizen. My husband is in canada on an expired student visa (the visa expired over 6 years ago). He has been working here for years and has been paid in cash. He has a valid British National Overseas passport. How do we explain the situation?

What is there to explain? He overstayed his CVV, he is out of status, you love him, you married him, it is a real relationship, he is only one of 400,000 undocumented workers illegally in Canada!

What you need to do is PROVE the marriage is real. Not that simple!

I doubt the two of you want to be seperated so your going to sponsor him as an out of status in Canada application because of several reasons. You probably would miss him and vice versa and you may need his income to maintain your standard of living. So submit these forms http://www.cic.gc.ca/english/applications/spouse.html and LOTS of proof.

Proof is not the necessary wedding photos. The photos CIC cares about is relationship photos.

Photos when the two of you are relaxing at home, at a dinner party laughing, swimming together while playing, photos with you leaning on him the same way and him holding you the same way, outing photos when you went sky diving, rock climbing, fishing together, camping together etc. etc.

DO NOT TAKE A PHOTO OF THE TWO OF YOU IN THE BATH TUB TOGETHER OR IN STATES OF UNDRESS! That will imply that your relationship is bogus and your trying too hard to be approved.

Get a bucnh of letters from your friends stating that they know how much you care about (SAM) and how different you are now since you got married to (SAM) and just how devastated you would be if (SAM) got removed and MAKE SURE THEY ATTACH GOVERNMENT PHOTO ID SHOWING THE WRITERS ADDRESS AND STATUS IN CANADA.

Thanks for your reply Roy. From your experience, what are our chances of a successful sponsorship? Our marriage is legit but I have heard that some legitimate sponsorships don´t get approved but bogus ones do!

About the pictures, in the past years we have various pictures here and there at various places with various friends. Unfornately, we did not have a wedding party as we planned on having it in his home country after he is landed in Canada and also because we decided that saving money for a house is more important than throwing a party. Is this okay?
