I-94 departure date

Subject: I-94 departure date
  Hi,Uniden and others on this forum.
The I-94 has a date as March 28 2007.Can one leave US closer to that date like March 27.This is regarding the H1-B visa where the 6 year period ends on March 18.I guess at the port of entry they have given 10 days grace period.Will I have a problem when I decide to return to US at some point will they question me about the departure record.Please give me your suggestions

Anna,

Is the date of your H1-B expired, but your I-94 still valid as of today? Are you leaving the US and plan to return, or do you plan to stay in your country?

If you are planning to return to your country for good, then you can exit the US any time between now and March 28. If you exit March 29 or later you would overstay, since your legal status in the US expires at the end of the day on March 28. Even then, you could still overstay for up to 180 days without major repercussions, but it certainly doesn´t leave a good impression with USCIS.

Short answer:
No, you will not have any problem exiting the US on March 27 or 28, and there will be no problem re-entering later.
You will need a new US visa to re-enter the United States.

Thanks Uniden,
My H1-B visa expires on March 18 2007 total of 6 yrs but the I-94 is valid till March 28 2007.I will be moving to canada after that and then plan to return after a year to US as of now.So deciding as to when to leave US wanted to know if it okay on 27 march.

It is Ok to land on the 27th or 28th. I-94 has the right expiration date. Go by the I-94.
