Well if there is no evidence to the contrary there is no evidence.

Do they still communicate? Any Lawyer or notary can get them to sign an affidavit stating they have parted their own ways and neither have any claim on the other etc. etc.

Hello.

I had a similar problem, I had a previous commonlaw relationship to a girl for a few years, and my wife who I am sponsoring from india had no previous relationships. Me and my ex no longer communicated so I just went to a lawyer and got him to make an affidavit. Make sure on there it says "Declaration of Severance of Common-Law Relationship", you just get him to list out the points like your ex´s last known residence, usually city, province/state, country etc, how long the relationship was, and where did it take place, and how long have you not been communicating with one another, or how long since not living together (if you are still communicating), you don´t need to get ur ex to sign, you just need to sign and get the lawyer to sign it. My lawyer made it for me for 50$ here in Surrey, B.C.

hope this helps.
