Subject: Marrying an American and Living in the US
Hi there. If someone could help me with this question I´d really appreciate it. My fiance lives in the US and we want to get married and live there (Tennessee). Does anyone know about me getting married while I visit her and then filing to stay in the US from there? Can I do that?I´d really appreciate any info anyone has. This is hard to figure out. Thanks so much!

Status (in reply to: Marrying an American and Living in the US)
What is your status in the USA?

Are you on a visa? or just visiting (without papers)?

Basically you can´t do much if you don´t already have official authorization to be in the USA for anything but visiting. You might be able to apply for a change of status, but you´d have to already be married.

I went through something very similar with my girlfriend (who is now my wife).
From what we could see is she (being Canadian) would have to remain in Canada, while I (being American) would have to petition to get her a K-1 Fiance Visa. Alternatively, if we were already married she would still have to remain outside of the USA while we would apply for family class visas. Either way takes a while; the K-1 Fiance visa takes about 8-9 months, the spousal family way takes atleast a year, usually more.

It was for this very reason we decided to come and live in Canada. I will have permanent residence in hopefully 6 months, with the possibility of working before that. Additionally, I was given a year visa to simply apply for permanent residency, does it get any better than that?

My recomendation:
If you already have a legitimate visa (student, work, etc...), get married, apply for a change of status. During this time you cannot leave the country, as your residence is in a state of limbo.

Thats pretty much all I know... email me if you need more info either way.

Cheers

what FP said is true.
I immigrated to the us after marying a us citizen. I had to wait in canada for 9 months after my husband and I got married. I was not allowed to go visit him but he could come to canada to see me. Then I got a work visa 6 months after I was admitted to the us ( they say it´s supposed to take no longer than 3 but that´s not exactly true!)
You are not supposed to just go get married there without a fianc? visa (which takes a while to get too) but you can take a chance and not tell the custom agent you are going to get married. Then after you would get married, you could not leave the country and you would be stuck without a work permit for a while...thas´s no fun!
There is also the problem of moving your stuff down there with you. You can´t really cross a border with a truck load of furniture and say you are going for a visit!

I am a canadian and got over the border a few days ago on what is called an arrival/departure pass which is only good until the 29th of August. We are getting married here and I need to know if by being married I am allowed to stay here. Can they make me leave? I am going crazy trying to figure out what I can do. I don´t need to go back but am not sure if I have to even after we are married. Thanks

I want to marry my American girlfriend who lives in LA. I am Canadian. We both want marriage. I don´t need to move alot of ´stuff´ to the US... mostly just me. Can I just marry her and then file for the correct paperwork... whatever the heck that is (please enlighten me)? I also wish to work there as soon as possible. I have a 4 year old daughter who will also need to visit (summers and holidays). Please help...

marrying an american in canada (in reply to: Marrying an American and Living in the US)

Just a quick question I am currently a canadian citizen and want to become a naturalized citizen of the United States one day. Though when i decide to get married would i be able to come back to canada to do so? assuming my future husband will be an american as well. What kind of ramifications would there be to do this? If you could reply asap that would be amazing

thanks so much!
