Subject: Help - My DH is a resident but I am not
  I hope this isn?t too long for anyone to read. My husband was born in Jamaica and grew up in St. Kitts. At around 11 years old he moved with his family to Canada and became a permanent resident. After a few months his parents moved back to the Caribbean and he eventually lost his resident status. He recently appealed to have it re-instated and he was granted, so he is now a permanent resident again. Immigration has informed us that he has go to Canada, get a job and apartment for a few months and then apply to sponsor me his wife and our 9 month old son. The process could take up to a year or more. We cannot imagine our family being separate for so long. We are leaving Jamaica because it is too violent and dangerous here ? he doesn?t want to leave his wife and baby alone in such a place. Is it possible for me to try to go with my husband by applying for a skilled worker visa and then applying for residency once I get there? I have an honors degree in TV production and advertising and I have at least one job offer from a company in Canada. I would apply for this visa in a heartbeat but I don?t want to do anything that might jeopardize my application for residency when it is time for him to sponsor us. I don?t see the sense in staying here with our lives in potential danger when I could go with my husband and help him to earn. He also has family there that will help us with anything we need. I guess I just need some advice. Also, if I do get a skilled worker visa, my baby would be allowed to come with me to Canada, right?? Thanks in advance.

Your husband got his PR status re-instated ? After how many years ? WOW!!! You said he left for Canada when he was 11. Then came back to Jamaica with his parents. How old was he then ? How long was he in Jamaica for before applying for re-instatement?

Well since Castaway´s message didn´t help at all, you might want to go to www.cic.gc.ca and check out ´spousal sponsorship´. It´s true that because your husband is a Canadian PR he has to be in Canada to sponsor you (citizens don´t have to be), but you can be sponsored from within Canada if you apply for the married partner PR. I wouldn´t bother with the skilled worker visa as it takes so long to process, even with a job offer sometimes. The only disadvantage of applying via married PR is that you can´t work for 8-9 months as it is being processed, so it is quite a financial burden and if that´s not an option I would suggest you go for skilled worker or apply for married PR outside Canada (the processing times are on CIC´s website, but I didn´t think it took as long as you said - a year or more? You might want to check that.)

One thing I would suggest is that if you come here and apply within, you might not want to tell customs and immigration that that is your exact intention. They might not like the idea of you coming with your husband who intends to stay, when you don´t straight away have the correct visa (I mean PR, even if you have the right one for entering Canada - not sure if Jamaican citizens need one). Once you are here, you can keep reaplying for visitors´ visas until your PR comes through. That´s what I did and I´m now a PR, although the waiting is hell!

You have some tough options and they might not all be nice but there at least IS a way to go to Canada to be with your husband!

A child can not abanadon Canada as his/her place of Permanent Residence under the former act and Castaway (buddy) should know that by now!
