Subject: spousal sponsorship approval, roy please help
  I was wondering if anyone has expeirenced this? I got married to my husband (canadian citizen) in Aug, 06. I came back here to the US. I changed my maiden name to my current last name in October. We filed (using my married name)(one question asks for your maiden name or other names you have used)out all the paper work and sent it to Missauga. On March 9 he received a letter of approval for him to sponsor me (and they stated my maiden last name instead of my current). Should this send flags flying because they used my maiden name, or doesn´t it really matter? The only ID that says my maiden name now is my Birth Certificate. I might be making a mountain out of a mole hill, but i´d rather be safe than sorry.

What name is on your passport/travel document? That is the name you´re supposed to use when applying. If the only "travel document" you produced was your birth certificate, they would use that name. That said, it´s really not a reason to panic. You will need to get a passport in your married name before the PR visa is ready to be issued anyway. When you submit your passport in order to receive your PR visa, it will have your married name (which will coincide with your application and marriage licence) and they should issue PR in your married name. Hope this helps.

I gave them a copy of my birth certificate and a copy of my passport, as required. My passport says my married name. And, yes your response did help. Oh, my marriage lisence also said my maiden name, because at the time i sign the marriage lisence, i didn´t know i could sign it with my would be married name. Sorry, i´m making this so confusing.

Once you have your file number you might want to fax a something to CIC with a copy of the letter your spouse received that includes your maiden name, and another copy of your passport, just to politely "notify" them that they´ve made a mistake with your name. You can reiterate that you want your PR issued in your married name. Still don´t think it´s a reason to panic, though. Everything should work out fine in the end.

Hello kc,
I think Oromum made a mistake saying that you have to get your married name on your passport before the visa is issued. you can still get your visa in your maiden name. CIC uses the name on your passport and if it has only your maiden name, that is waht they use. If you passport has your husband´s surname, they will use this.

IT ALL DEPENDS ON THE LAW WHERE THE MARRIAGE TOOK PLACE. IF THE COUNTRY, STATE LAW IS THAT YOU MUST OFFICIALLY CHANGE YOUR NAME THEN JUST TAKING THE HUSBANDS NAME IS NOT ENOUGH.

OROMUM ADVICE IS NOT WRONG IT DEPENDS ON THE LAW IN THE STATE/COUNTRY WHERE YOU GOT MARRIED AND CHANGED YOUR NAME. IF YOUR TRAVEL DOCUMENT AKA PASSPORT IS IN YOUR FORMER NAME THAT IS THE VALID NAME TO USE.
