I had a similar problem, I had a previous commonlaw relationship to a girl for a few years, and my wife who I am sponsoring from india had no previous relationships. Me and my ex no longer communicated so I just went to a lawyer and got him to make an affidavit. Make sure on there it says "Declaration of Severance of Common-Law Relationship", you just get him to list out the points like your ex?s last known residence, usually city, province/state, country etc, how long the relationship was, and where did it take place, and how long have you not been communicating with one another, or how long since not living together (if you are still communicating), you don?t need to get ur ex to sign, you just need to sign and get the lawyer to sign it. My lawyer made it for me for 50$ here in Surrey, B.C.

hi GURBINDER/ROY

did this happen after you landed ?...and were a PR already?...did you then submit that afidavit along with the new spousal sponsorship..

ROY or anyone else with experiance...

what happens...after you have landed and your common law did not...and you are seperated...can you or DO yo need to delare that she isnt going to be coming and you are not common law anymore?...or does it not matter?

Does this question mean you have your PR and are landing? If so, don´t you legally have to notify Immigration of this change? Also, for your own future, don´t you want to sever everything that has to do with this event from your old life and then cleanly move forward? Is there any chance of reconciliation? The question is bound to come up...say if you want Canadian citizenship you will have to explain this then. Hopefully someone will have a more learned opinion.

I have already done the landing...and we were/are trying to work things out...might be a chance or might not...it all depends...it happened really recently...so what i want to know is if in the future things dont work out...what is the recourse...during my PR stay in canada...can i at any time get an affidavit and declare that she is not my common law anymore....i have gone back ever since and plan to migrate within a year or maybe 2...any ideas anyone?

if your commonlaw partner was part of your application... did she land with you? there is a time limit for her to land. if she has not landed within the time limit (it says right on the documents they send based on medicals), her own PR opportunity dies. You would have to revert to a new sponsorship application - if things work out.

If she landed with you... and now has her own PR - then Roy may have to offer his expert advice. I would think it is the same as filing for divorce.

I am not clear what has to happen with your status and CIC. I would be inclined to advise them of your change in status once you are clear about your situation - just to be on the safe side.
