Subject: Refugee claim and family sponcorship
Dear friends. I would like to ask 1 serious question.
If someone came to Canada and claimed refugee asking for asylum within Canada.According to experience of the other people it´ll pass 1 or 2 years untill the decision on his/her removal will be done. The question is that,if within the period of reviewing refugee case the person, who claimed refugee, got married Canadian citizen? Will he/she be able to apply for permanent residence under the Family Sponcorship category?I mean to make inland application?
Thank you in advance for answer

This is interesting. Is it "YES Absoulte"? I mean for every case or ONLY for those who enter Canada normally then claim refugee at later point? What if he/she is refused finally and comes face to face with departure/deportation?
What if the refugee claimant has used fraudulent ID, or with no IDs at all, or entered Canada illegally, does "YES" still apply? what if CIC suspect the issue of marriage of convenience?
Also, I heard that CIC or IRB normally keep/withhold passports and other IDs of refugee claimants till time of final decision. In this case, how can they get married without these essential identification.
I am so curious, having been waiting and waiting for my out of Canada family sponsor to come to an end. ...so, please be patient.
Thanks

If the marriage is REAL and you prove it then the answer is YES. AS LONG as you submit the application BEFORE first PRRA interview. See Operational memo 018

Thanks Roy.
"Yes" even with phoney documents or no ID at all!! this sounds ridiculous and unfair. My husband was not even allowed to attend the birth of our first child and we are still waiting for the endless game. Regugees receive work permit from day one and live normally with spouse in Canada. How easy one can do the short cut into Canada!!
