Subject: Leaving Canada while PR is being processed
  Hi -- I am sponsoring my wife from within Canada.
We submitted the complete application in Oct2006. We recevied a confirmation that our case is being processed in January2007.

1- when is she going to get the approval in principle? and when is she going to get the final permanent residency?

Also, we were told that she cannot leave Canada while she her application is being processed. For urgent reasons, she has to leave Canada for a whole month in Dec2007. We were told that the real problem is that (i) her PR application might be cancelled, and (ii) she might be denied re-entry to Canada.

2- How can she leave Canada and come back without her application being cancelled? First we thought of leaving and returning through the US but because we are going to LatinAmerica, so we are still in the risk of not being accepted for re-entry into Canada. What can we do?

There is no way that you can guarantee that your wife will not be refused re-entry to Canada, thereby jeapordizing your PR application. Allowing entry of any foreign national to Canada at any time is completely at the discretion of the Immigration Officer at the border. Does your wife need a visitor visa to enter Canada? If she does, trying to come in through the States won´t work. Either way, if she´s refused entry, you could lose your application. Sorry. It´s your choice whether to take the risk - depending on how critical this trip away will be.

1) AIP comes 9 months after your application has been submitted. Final PR can come anywhere from 0 (comes with AIP) to a year later.

My PR took 18 months from start to landing and I have no background of interest (no kids, no problems, from a Western EU country). I don´t think she will get it before she is supposed to leave, and I would STRONGLY recommend her not leaving. As the others have said, is it worth the risk?

My case is similar but both my wife and I have Multiple-entry Visas. This guarantees that we wont be denied re-entry into Canada. Can someone plz let me know whether or not I should leave Canada to visit my family for about a month?
