TRV denied...now what??

Subject: TRV denied...now what??
  My friend was denied today in Damascus. They said that they did not believe that he would return to Syria. We had every document required, and a plane ticket for 4 weeks. He was invited by my BIL and sister, and was coming to see a sporting event here in the city. He has property, a vehicle, and a bank account in Syria, but they still said no.

So, my question is "Now What"? Is there an appeals process? We are having strong feelings for each other...if I go over there and marry him will they be even more hard nosed with his spousal sponsorship now that he has been denied a TRV?

Please, any advice would be appreciated.

Just because your brother In Law invited him is not a reason to let him in. There are so many reasons that could have been a valid reason for refusal. Like how did the two of them meet. What was he being invited for that he could not do back there?

If you do go over and marry him tell the truth that the trip he was invited for was to see if a marriage was the next step.

Something that was done led them to believe the visit was more then what was written about.

try again. does he have job with a set vacation? You need to satisfy CIC that he goes home.

we had to try 4 times before we were successful.

There is no appeal for his TRV denial.
However, If you get married you may sponsor him to come to Canada.
If you are a Canadian citizen you may sponsor him while you are outside of Canada, if you are a PR you have to be in Canada in order to sponsor him. He may stay in Syria until the process is done.

Thanks for your responses. I am a Canadian Citizen. He was coming here to meet my family, and to see whether or not we could like each other in person. My family was the host family. They invited him to come in July during the World U20 Soccer Championships. He and my BIL have also developed an online friendship that has lasted for over 6 months. He truly was going to return to Syria after three weeks.

He has a job. He has a property deed. He has a vehicle. He is the only son in the family and is supporting his mother and sister and grandma. He has travel history which shows European destinations for work, but none for tourism. He has $8 000 Us in Cash. What more could he have done to convince them that he would return?

Now, if i go to visit him, should it just be a visit to set up a pattern of history? Or should we just "bite the bullet" and marry?

Yes, he has a job there. They have approved a LOA for him. He was to return there within 4 days of landing back in Syria. I just feel so "empty". We did not think that they would make an immediate decision, without them going through his paperwork at least.

Inviting someone to attend a major event like what you stated is PROBABLY the reason for refusal.

If your in Canada and remember the news about the world AIDS conference held in Toronto. How so many who can´t afford the drugs to keep them alive in their home country making refugee claims after the event even though they signed statements they would not or Cuban baseball players or Russian Ballet dancers in the sixties all made refugee claims.

The Visa Officer thinks HE looked up about this sporting event on the internet and got a buddy to invite him.

The content of the letter is what sunk you.

I hate telling you the truth but I could of written a much better letter.

I learned the hard way by inviting my NOW wife who was working at a US Embassy abroad to visit Canada and she got refused.

We learn by our mistakes hope all works out for you as it has for me.

Thanks Roy for your help. In your opinion, what would be the best course of action from this point onwards?
If you were in my shoes, what would you do? And can i hire you if i am in Edmonton?

If I were you, I would go to Syria, see him on his own turf, meet his family, see his friends, and be very sure his intentions are genuine. Come home - think about it... and go back 6 months later to marry him. If he has the ability to work... consider trying a work permit for him.

the idea is to make YOU the focus of his attention not the possibility of Canadian residency. If the second trip ends in marriage, sponsor him.

during all this time, keep phone records, emails, plane tickets - all the things that verify the relationship.

I am telling you the slow and cautious way but I would suggest it is also the best way.

Whatever you did or write, the visa officer will not be satisfied with your visit request.
You have to continue your trials taking in account you will spend money for each trial.

Linda is absolutely right. There is no refund with a failed TV application. You get to pay for every attempt.

what makes this exercise interesting is that the IO in Syria is accountable for every TV that is issued. If your man does not return, it affects the job performance of the IO- and potentially his next raise. If there is the slightest doubt, the IO will say no rather than risk it.

Whatever you do, make sure there is no incling of romance in the letter of invitation.
