  Hi,

I am currently on a post grad work permit. I am married to a Canadian. We r moving out in May. Unfortunately my work permit also expires in May.

He is going to sponsor me within Canada. However I spoke to a lawyer today and she said that I might get deported since my visa expires then and it doesn´t matter that I am married to a Canadian and we r living togather.

I am worried and I wonder if anyone knows anything about this?My company has agreed to keep me in the job as long as I have status within Canada.

Or implied status as what the website has mentioned.

Implied status is simple and it is implied. For example an applicant applies to extend their student visa and their status expires before they get the answer from CIC on their application.

That means until their student application is refused or approved they are deemed in status or they have implied status as if they are in status.

Which Lawyer told you could be deported?

I´ll tell you that you could win the lottery too!

Neither are not likely, being deported is impossible if you comply with the IRPA.

You are married yet you have not submitted your spousal sponsorship application? Why not?

You right now before May (whatever) can submit an in status spousal sponsorship and ammend your status. Call 1-888-242-2100 and they will explain it more clearly to you.

Prove the relationship by supporting letters from in status friends, PR´s & Citz´s and tons of photo´s showing the two of you having fun and laughing together.

LAWYERS ARE NOT EDUCATED IN IMMIGRATION LAW WHEN THEY ATTEND LAW SCHOOL.

HE/SHE SHOULD KNOW BETTER.

WHAT YOU DO IS SUBMIT THE COMMON-LAW SPOUSAL SPONSORSHIP SPONSORSHIP AND IN THE SAME ENVELOPE APPLY FOR AN OPEN WORK PERMIT WITH THE BELOW FORM. YOU CAN CONTINUE TO WORK WITH IMPLIED STATUS UNTIL THEY LOOK AT THE SPOUSAL SPONSORSHIP APPLICATION.

I agree, the lawyer that you spoke to was completely uninformed and I hope you didn´t have to pay her any money for that lousy information. That said, you are responsible for maintaining your legal status if you intend to remain in Canada. There are several ways to do this - and what others have said here is very true. If you intend to file an inland application, include an open work permit and the associated fees in the same envelope. If you are from a visa exempt country it´s possible to return home, and the re-enter Canada with your spouse - proving your legal marriage - and get extended, legal visitor status that allows you to stay in Canada while you wait for PR approval, even on an "outside" application. The important thing is to remember that you are responsible for maintaining legal status - and because you are married to a Canadian you do have an advantage. Find out, through questions posted on immigration forums such as this one, and through research of the CIC website and the accompanying CIC processing manuals, which solution works best for your situation.
