Subject: Labour Market Opinion
  I am currently working in Canada.I entered as a refugee claimant and was denined. I have a positive labor market opinion valid until 07/30/2007 and I understand that I need to apply for a temporary work permit OUT OF CANADA. I´ll be going to my country 15 days before the Labor market opinion expires. Will that be good enough so they won´t tell me that I waited too much to go and requete my temporary work permit.

This situation is given the situation that I´ll apply for my permanent residence before submiting the temporary workk permit application. I need som orientation on this. I don´t want to apply for this too late, I don´t wan to lose my Positive LMO.

you can get work permit from canadian mission is usa, (if u have US visa), that will be fast

You were denied as a refugee, now did they give you a Volunteer departure order or any kind of removal order?

The LMO doesn´t garanty that your visa is going to be approved.

You are going to need to prove that you are going to leave Canada at the end of your permit.

Then, what can I show to immigrationas as a proof that I will leave at the end of my work permit??? I haven´t received yet any removal order. I will do a voluntary depart to get my passport back and go back to my country. I understand that if I leave before I get the removal order there should be no problem to go back if i put my intentions clear when applying for the work permit.

You need a confirmation of departure. You need to inform CBSA that when and how your leaving so that your enforcement file is at the POE/Airport.

I got a Portuguses family who had been deported able to return on a work permit. You will need to seek the consent of the Minister to return. Thinking this will all happen in a week by yourself doing it is a dream.

It worked because of me, the employer and the client!

Roy, I really appreciate your realism in my case. But as per the story I read from that portuguese family, I need to tell you that there are no similarities at all. First, i came here with my daughter and husband applying for refugee protection. This means we have never been ilegal in the country, all the time and currently we have hold a valid work permit. We are both engineers working for the oil & gas industry in Calgary and the only similar thing is that we also want to be able to come back and become permanent residents. I think we do classify under the skilled worker class with more than enough points, my only concern is that I don´t want to wait 2 or 3 years for that but instead to come back with a temporary work permit while my PR application is running.
