Subject: Impoting of car
  Hi
I have completed my landing process and submitted list of goods to follow which included two cars (documents of ownership were attached to list ).I came back to US to complete my contract.Recently i had an accidient and my car was a total loss ,so i had no option but to buy another one which is financed .
My question is if i pay off the finance and then i own the car can i take it to Canada as a replacement for my car(tota loss) without paying duty. I would really appriciate if some one could help me solve the problem .

No - you need to pay duty now. I asked this question to border officer and he advised - you need to pay duty if VIN# changes.

I do know that if you have to replace an item already on your GTF list (like a TV, say, that blows up and is then replaced by a new one), you ARE allowed to do that duty free. There may very well be rules in place to determine whether or not it was a necessary replacement, or whether the new item has a similar value to the old one. I don´t know why it would be different with a car, especially since you have documentation that proves your need to replace your "original" car; I would contact customs at the border where you landed, and be certain to keep a copy of any documentation you have to prove your case. Best of luck, and I hope you´ll let us know the verdict.
