Subject: visa and stay
hi, i was in legal status in us when i filed my case for skilled worker now i am not in legal status . but case with canada is also pending . would it help me or hurt me in this case.

I do not think it will help you. It may or may not hurt you though. If immigration officer thinks that you do not give damn about the laws in US then he can just refuse you. However, this does not happen in most cases and people are able to get through.

It is a BAD idea to remain illegal in the US, no matter what,you should never be in that state.

They may think you can do the same in Canada and be illegal.

One of my friend was denied a Canadian visitor visa because while his case was pending his H1-B had expired.

Once again it is a BAD THING, make yourself legal or quit the country and inform CIC, that is what I would strongly recommend

You should give more information. When did you apply? Hopefully it will not effect much... But do remember that the US and Canada share every single piece of information between them.

I APPLIED LAST JUNE 06. NOW I AM WAITING . BUT THIS JANUARY 07 MY CASE WITH USCIS WAS DENIED . HOWEVER I APPLIED FOR A DIFFERENT CASE SOON AFTER THAT WHICH IS PERM BUT THAT TAKES LONG TIME. I GUESS THAT MUCH INFO SHOULD EXPLAIN THE SITUATION SO YOU GUYS CAN GIVE YOUR THOUGHTS ON IT.

op1 5,17,2,i ´a person who has entered a country lawfully but at some time subsequent to lawful admission has lost legal immigration status is considered to have been lawfully admitted, whether or not status has been restored at the time of the application to the visa office. Such applicants may or may not qualify for a visa, but their application must be accepted for processing and assessed on its merits.´

It may not affect directly your application since it is in process and you were legal earlier but ... they will surely find out about your status and then .. it is up to them, doesn´t look good.

Synopsis: Losing legal status in the country where the application was filed, after being LAWFULLY ADMITTED for at least one year, does NOT have a detrimental effect on your application.

That is what everybody on this thread said nothing is going to happen but it also depends on immigration officer take on the situation he can use negative substituted evaluation since the person in picture has no regard for the laws of the country. However, immigration officers usually do not do this. My take on this situation I cannot guarantee you that nothing will happen but most cases in similar situation get through.
