To apply from within Canada you should have been legally admitted for a period of 1 year to Canada. This means if you obtain Canadian work/study permit with a validity of 1 year then you can apply the day you land in Canada.

WHOA SLOW DOWN.

Did you enter on a work permit then get offerred another job from a different employer? Have you applied to ammend your conditions of entry and are you authorized to work for this new employer?

Regulation 11 allows all applicants to apply at their countries Visa Post or in a country they have been lawfully admitted for one year.

If that is the case then you can submit at the Buffalo Regional Processing Centre RPC or in your countries Visa Post what ever that would be.

If your in Canada and on a valid work permit I would suggest approaching the Provincial Immigration Department and seek out a Provincial Nominee Certificate so you can apply as a PNP Provincial Nominee Program PNP.

Once you obtain your PNP certificate by satisfying the provincial PNP people that you have an offer of full time employment and you wish to reside in their province they will give you a certificate that will increase your points.

Details of the various PNP programs can be found here http://www.cic.gc.ca/english/skilled/provnom/index.html
