Subject: Crossing border while Application in process
  Hi - would love some insight/help - thanks!

I´m a U.S. citizen that just married a Canadian citizen. We´ve submitted our Permanent Resident application recently, and now I´m planning to pack up a moving van and drive to Canada next month. I´ve spoken with the Canada Border Services agency and know all of the Settler´s effects regulations.

I´m wondering if I´ll be ok crossing the land border with simply a U.S. Passport and our marriage certificate and a list of my effects, if I communicate that my application for Perm. Resident is in process.

The Immigration Regulations do not allow for common sense. You know your Canadian loves you and you love her. It should be obvious to most persons but the Law is the Law.

Just imagine the Canada Border Service Agency employee at the border and up comes this large U-Haul like truck loaded with furniture. The agent asks you

"SO WHAT IS YOUR PURPOSE FOR ENTERING CANADA TODAY?"

Your reply ------I´m married to this lovely woman and have applied for Permanent Residency in Canada based on my wife´s spousal sponsorship application.

The next question from the CBSA officer will be.

"SO YOU CLAIM YOU APPLIED HAVE YOU BEEN APPROVED"?

Your reply------- "NO"

Next question´

"WAHTS IN THE TRUCK"?

Your reply----"aLL OF MY FURNITURE AND WORLDLY GOODS"

Last question by the CBSA officer "SO YOUR PLANNING TO STAY PERMANETLY, CORRECT"?

You have no PR visa so turn the truck around over there and go back to the States UNTIL your approved. Visitors are people entering a country for a TEMPORARY period of time.

Sorry but it should make sense alot of sense.

Hmmm.

Our fallback idea is for her to drive the truck across and for me to cross separately stating that I´ll only be going for the weekend.

Anyone see possible issues with this? She would still likely claim all of the goods as her husband´s personal effects and could produce the marriage certificate.

If you truly intend to visit and your residence is what it states on your forms including your schedule one IMM 008 then few would see a problem. The goods are a problem that she would probably have to pay dutie and taxes on.

If one who intends to visit but decides to stay because the flowers at their friends house are so nice hmmmm.

By the time you should no longer be a visitor you will already be a PR so you decide.

Mike...STOP. Like Roy said, think before you act. I too, had the same logic as you, except I was a Canadian entering the US, already married to a US citizen. At the border, if you say you are visiting, you must convince the officials of that fact. (ie. where is your current place of employment, what date are you returning to work...etc) If they don´t believe you, your vehicle will be searched and if they find any evidence that you are not planning to just visit...you will be screwed. I ended up being banned from the US for 5 years, and subsequently, my marriage suffered and eventually ended. If you really love each other, wait whatever time it takes to go through the system honestly. I wish I had...
