Subject: Relatives in Canada
  Hi all,

I am applying for canadian immigration under federal skilled class, i have an uncle who is canadian immigrant (having citizenship) but now a days he is not living in canada. I need to know whether I will be rewarded points for this?

Law says your relative should be staying in Canada. However, if they do not ask for status proof then you are good to go.

if you knowingly claim your relatives are in Canada - and they are not, you are guilty of misrepresentation. Instead of gaining 5 points you may lose your PR opportunity.

If you need the 5 points I would look for another way rather than risk lying.

As mentioned above if they do not ask then you do not have to provide. If they do ask, then you will have to show utility bills, bank account with activities, etc. In the document checklist they only ask you to provide the following: photocopy for PR card, record of landing, citizenship, etc. This is a grey area as you can submit these and if they award you 5 points without requesting for another proof then you cannot be charged with misrepresentation as you are not lying.
