Subject: Can I sponsor my spouse if he has a DUI?
  I was wondering if someone can give me some advice... My question may or may not have been answered in other threads, so I apologize in advance for any duplication.


I am a Canadian citizen and my boyfriend is an American citizen. My husband and I plan on moving back "home" because I want to be closer to my family once I finish school here and he has no family left in the states.

My question is can I sponsor my spouse if he has a DUI? He got his DUI 3 years ago - 1 year before we got married. Also, will his DUI cause him problems in finding a job in Canada? When they do a criminal background check in Canada for employment does criminal offenses committed in the states show up?

I´m confused here...

Is he your boyfriend or husband? You used both notations.

Regardless, DUI is an acronym for Driving Under the Influence. Essentially driving while drunk/high/etc

Nonetheless, their decision on his criminal history in regards to the DUI will definitely involve the circumstances of said incident. Were there people injured in the incident? Was there property damage? Is this his ONLY other prior charge [misdemenor, felony, etc]? If this was an isolated issue, and no one and no property was damaged, and he CLEARLY explains the situation and his remorse I think you´ll have a pretty good chance.

However, if this involved numerous victims, eccessive property damage and jail time then you´ll have a hard time getting around them because those are serious charges.

Sorry the 1st couple sentences I copied from someone else post since it sounded so good and I didnt know if this question had been posted and I just couldn´t find it and I guess I missed that little word. sorry for the confusion.

He is my husband, we have been married 2 years.
Yes there was property damage and no one was hurt. He rear ended a car that suddenly stopped in front of him - he was following a bit close because he assumed the car in front of him was going to catch the light and he was going to follow it while it was still yellow - the car in front decided at the last minute that oops I better stop it is going to turn yellow. The driver in the car in front of him had more blood alcohol in them then my husband - yet my husband was still issued a DUI when actually he only had 2 beers the whole night because the officer in charge smelled too much alcohol on him. (One drink was at dinner and one after dinner just before we left the resturant. )The courts were not forgiving and refused to dismiss the charges since there was an "accident" because of the officer´s testimony and it came down to who said what and well my husband lost.

This is only charge he has, there was no jail time and he has no prior criminal history.


Who makes the decisions? Is there a number that I can call to get forms and get a pre-evaluation or something along those lines done?
