Subject: immigration lawyer needed ?
Hi..I am going to marry my same sex partner this month..she is already here and living with me. My question is...do I really need to pay a immigration lawyer when Ive looked over the forms, and they seem to be pretty straight forward? It isnt going to be a complex case...and am wondering has anyone in the same situation completed the forms themselves..and if so, would they recommend doing it solo, or using a immigration lawyer?

Thanks

You have the option on the forms for same sex partner (I think they call it common-law partner) so this point alone is not considered as complex case. Make sure you provide all necessary documents.

Yes CIC made it easy and forms are easy to fill up. You do not need a lawyer for that.

However the good thing about immigration lawyer is that they know about the latest updates of the law and it is their job to help you in preparing your case, they are helpful for contacting immig offices when needed and so on.

If you can afford it it is worth it, if not you should be able to manage on your own. Or ask help from this forum! :)

thank you ...actually because we will be married she is considered my spouse..separate from the common-law area.

I dont mind paying a lawyer...just looking over the forms seemed fairly straight forward for sponsering my spouse since she is already residing here and we will be married shortly.

thanks for your info :)

Never believe that filling in forms by yourself would prove that their is a bond between the two of you.

Since she is (already here and living with you) proves nothing she could be an illegal roomate helping you cover the cost of your rent.

Is your partner in status or out of status makes a big difference in which set of forms you use. Hate to see the whole application sent back to you.

The onus is on the two of you to establish that your in a real marriage not Immigration to prove that your not in a genuine relationship.

Ask yourself this question. How many failed refugee claimants or out of status students would be likely to submit a bogus application implying that they are in a same sex relationship.

Do it yourself, you could be successful and did you win the 30 million in the lottery last night? Is your partner worth the risk?

Your far better off hiring a consultant then a Lawyer who will assign it to the knewest member of the firm who knows nothing. Their are several same sex specialist in Toronto and Vancouver who have plenty of experience in this field.

They even have photos of their same sex success stories on their web site.
