Subject: Complicated question (hope not!)
  Hey all,

I have a complex case, I believe.
I lived in the US, for about 3 years, under a tourist visa (which is to expire in 2010). However, my I-94 expired after my first year in the US, so that means, I was "illegally" for 2 years, although I never received any notifications whatsoever about this (INS always had my address).

I am now a canadian resident, I want to travel, and some flights sto pby the US. I´m wondering whether my tourist visa would still be valid or not...or where/how can I find out whether I Can still use it or not

Any info will be appreciated!! :)

You were an illegal alien in the US. That´s a violation of the law and more likely you would be refused of entry in the US.

Regardless if you go to the US only in transist, you have to meet the requeriments of entry.

Once you are refuse of entry your visa will be revoked in the spot.

The issue is the evidence and do they really know that you were illegally there? There are no exit visas but they could track you but highly uinl;ikely they do not care.

If they do not have any proof of when you actually left then you are not in much trouble. If they do, you already know what may happen.

As far as I know, if you lived illegally for "x" amount of days in the States, then you´ll be banned from entering to the States for "y" months/years. If I remember correctly, if you stay illegally in the States for more than a year, then you´ll be banned for 10 years!

You can apply and try your luck, but DON´T lie if they ask you. They are smart enough and can figure it out. If you lie to the government and they come to know, then you may get in a much bigger trouble!

I know a non-American person (student) who bought a car for about $4000 and didn´t want to pay taxes to the state government (he wanted to save few hundreds) so he lied and put the amount as $500 on the car registration paper. Guess what happened, they figured that out since he paid to the seller by wire transfer and he has been deported and banned for 10 years!!! He also had to pay the tax money before he left!

I´d contact a lawyer and get professional advice on that.

Thank you everyone for your input. It isn´t a big priority for me to get in the US, I can always take more expensive flights that don´t stop in the US, I might just go to Buffalo driving and see if they let me in, and if not, well, no harm done, back in Canada :)

I´m not scaring him, just trying to be honest. If you live in the States, then you probably know what I´m talking about.

Anyways, as Sebas stated, he can just drive and see if it works.

There are at least 10 millions illegal immigrants in USA. I know an accountant (CPA) who has been illegal in USA for many years. He has been working for someone of power there NY) and receiving minimal wages. I know, in person, somone who had been illegal in US for many years and all of sudden he came to Canada, how? ..hmm do not ask me. He then got married to a Cnd PR, made her pregnant instantly LOL, and he is still in Canada. What do you think Alex?

Guys, There is no black or white in some of the life´s issues... I know someone who visited the US to attend a conference( one day visa) and over stayed for 6 years, got his GC, went back to his country and has been doing great!!

There are also people who do nothing wrong and are deported just for having outstanding parking tickets!!

I know sometime after 911, one 7 month old baby was on the US list of 100 most wanted by FBI...

There are things beyond our control. We should do what we can i.e, be honest and human and hope for the best, while being prepared for the worst.

I´m not denying that there are millions of illegal people live and work in the States etc, but that is not a justification. I got speeding ticket for driving 75 on 65 MPH road and when I complained that everyone was speeding, the cop told me: that doesn´t give you the right to speed! And he was right but the actual reason for pulling me over that I was driving a cop magnet (Red Coupe Car) and he thought I was drunk.

Sometimes the government over reacts for no obvious reasons. I guess I was trying to say the same as Almost Perfect stated, "be honest and human and hope for the best, while being prepared for the worst."
