Subject: Class Action lawsuit against Immigration Canada
  Hello Everyone,
I am interested in launching a class action lawsuit against Immigration Canada for unfair processing procedures regarding spousal visitor visa (TRV)applications. Immigration Canada routinely rejects visitor visas for husbands and wives to visit each other while their permanent resident applications are held up in often multi-year backlogs. This is a violation of human rights under the Canadian Charter as well as a violation of the International Declaration of Human Rights to which Canada is a signatory. The discretionary nature of Immigration Law makes their descisions beyond reproach and this cirucumstance needs to be changed to eliminate the institutionalized discrimination that exists in the processing of applications.

Immigration Canada states in their processing manuals that dual intent visas are possible to get if the reasons for visiting Canada are deemed to be legitimate and if all the paperwork requirements have been met, including the payment of the processing fee. Immigration Canada almost certainly rejects almost all dual intent visa applications and are thereby misrepresenting the dual intent program. As a Canadian citizen, I have been a become a victim of this unfair processing as my husband has been refused the right to visit me as our Permanent Resident Application is processed.
I am seeking others who want to join with me in a class action lawsuit against the unfair processing procedures within Immigration Canada. I am also seeking lawyers who are human rights minded and knowledgeable about immigration to take our case.

Seriously processing time is so high that it leads NOWHERE.

the part that scares me is how they will make the waits shorter. They will not let that many more applicants in each year than they already do- so what will they do. They only choice they have is to reduce applications. Possible solutions- close some embassies until the backlog is caught up; change the rules so it is harder; raise the points so fewer people qualify; increase sponsorship requirements; change to a lottery system. Then the question would be if they make the rules retroactive will they have another lawsuit happening. Not good.

This seems strange because I was told by an immigration officer that my fiance can visit me while our application is in process. He has to state, when he arrives in Canada, that the PR is in process and that also we intend to marry. She said as long as we are completely honest...everything should be fine.

Should I be calling CIC again to verify what you are saying, is true?

My wife was verbally abused today as an imm. officer in santo domingo interview her; this agent actually caller a liar stating that we had gotten mmarried only for convenience.Can you give me an advise because I am thinking of sueing this agent.

Good luck trying. Visiting, whether invoking dual intent or not is always discretionary and visa officer are authorized to make that discretionary decision.
