Subject: Spouse Appeal

i have submitted a spouse immigration appeal to the IAD office in toronto, in August 2006. I called the appeal division yesterday since it has been a long time without any word. They told me I can get an early hearing date if my lawyer will request. I called my lawyer and told him this and he told me that there is no such thing for getting an early hearing and lawyers can´t do anything. The appeal division enquiry don´t know the correct information, so I would like to ask what my next move should be? Should I change my lawyer because they´re always busy. When I called them, they said don´t call again until your hearing. So please help me in this matter.

There is a super expedited process that CBSA staff really do not seem to review.

THE BEST PROCESS IS WHAT THEY CALL "ADR" OR ALTERNATE DISPUTE RESOLUTION.

Are you waiting for the same counsel who assisted you with your application that was refused that does not seem to know about the proper IAD procedures????

Here are the steps you and your Lawyer should have been following.

1. File the appeal with the Immigration Appeal Division IAD.
2. Same day go after an access to information to obtain the interview notes to understand what the visa officers concerns were. Four - Six weeks
3. When CBSA & IAD provide the record (your application forms & the officers interview notes) compare them to the access to information you have already received.
---Normal time frame three to four months from date of APPEAL SUBMITTED.
4. Provide your own submissions for the ADR regarding answers to the visa officers concerns and make sure they are numbered. They must be submitted in advance of your ADR date. Bring originals photos, mail, phone bills etc with you!!

I too felt the frustration of a refused spousal sponsorship (which I successfully won at an IAD panely on 06/19). Your lawyer is definately not doing what you are paying him/her for. I think there is little chance of success at ADR, however, your counsel should use the questions posed at the ADR to prepare you for the IAD which, in my experience, occurs about two months later, since they are likely to seek clarification of the same issues. Roy is talking about the same thing my lawyer did and he sounds more aggressive than your current counsel, that can only benefit your case.

If my spouses case has been refused, do you know what the cost
involved is for the appeal (approx)Lawyer fees and application fees and the time it will take
to get my spouse over to canada from india.
