| Subject: Are the rules going to change in January? |

I remember reading somewhere on CIC site sometime back that current rules apply to all those who apply before January 5 2005. I cannot seem to find such link now. Does it mean rules for immigration could change after that. I am located in Bangalore India. Anyone in Bangalore, do reply back onn this forum. We could exchange ideas. Thanks

Even if they do; your case will go as point system on the date you filed (or new if points are further reduced). They cannot increase points and judge your case on new point system

January 1 rule (in reply to: Are the rules going to change in January?) No comments on the languages being used, but here´s the thing about January 1 rule.
I´ve copied this from the Dec 11th Saturday edition of Toronto Star.
"Question
What is going on with the immigration department´s plan to take another look at applications from people who were caught up in the rule change back in 2002? Are all of these files being reviewed automatically, or do people have to re-apply?
Answer
Jan. 1 is an important deadline for scores of would-be immigrants who initially gave up on Canada when our rules were abruptly changed at the end of 2001. After a long legal battle, the immigration department effectively admitted last year that it was wrong to impose retroactively a major change to the rules for skilled worker immigrants. Back in 2002, the department insisted that many applications that were already in the system when the rules changed would have to be assessed under the new point system. After a public outcry ? fuelled in part by reporting in The Star ? the department finally agreed last year to allow all of the old applications to be judged under the old rules.
Under an agreement put in place with lawyers for applicants who mounted a class action suit, most of the applications were reopened and will automatically be reassessed using the old rules. But many would-be immigrants withdrew their applications after the new rules were published because they thought there was no point carrying on. And others were rejected when their applications were processed using the new, tougher point system.
Both of those categories ? those who withdrew applications that had been filed prior to 2002 and those with pre-2002 applications who were rejected under the new rules ? are eligible to have their original applications assessed under the old rules. But here´s the catch. These people have to formally resubmit their applications. And they have to do it by Jan. 1. That is in just three weeks. The immigration department says it cannot legally reopen files that have been withdrawn or rejected. The applicants must re-submit the application."
