Hi everyone,
First of all, I really appreciate everyone who takes the time to reply to the questions on this forum.
My boyfriend is in England and he has absolutely no status there at this time. He applied for refugee status there almost 3 years ago and was denied based on the fact that he went through Germany and should apply there. He does not have a removal order against him. He never went back to Germany and has been living illegally in England for the last 3 years.
It is really difficult for him to go back to his home country (Iraq) and for me to go and marry him there because there of the instability due to war. I want to avoid the possibility of going to Iraq and would rather marry in England.
So, my question is: can I marry him in England (at a church perhaps) for it to be a legally acceptable marriage? As well, can I sponsor him to canada after this even though he doesn´t have a resident status?
If he were to somehow regain a legal status in England for a limited time or perhaps in Germany (for example by re-applying as a refugee)
would that qualify as resident status sufficient to enable me to sponsor him?

It doesnt matter if he is illegal in any country. You can apply for him. You can marry him on Pluto and the marriage is accepted if Plutans issue your marriage certificate translated in English. So, dont worry and go ahead with your plans. Dont waste your time and money in trying for temporary status in England. It is not needed.
People have been living in the US illegally for years and still accepted in Canada.

Almost Perfect is correct but please take his advice in general terms. Every immigration case is individual. The stories of those illegal aliens in USA who have successfully immigrated to Canada may not apply to everyone. You are in a tricky situation indeed. Things have changed a lot in England and Europe in the past years due to the security issues and 11/9 era. The question is how can you both get married and where? You can travel to UK.. yes, as a Cnd citizen or even PR. But what about his legal status there? You still need to provide evidence of your residence in England (for 2-4 weeks prior to the marriage ceremony). For him to float on the surface and to go a head for a proper registry marriage in England, he may put himself at risk of deportation. The religious marriages over there follow the same rules. For him to come and marry you in Canada seems an impossible option. I do not know if he or you both would risk going to get married in Iraq! You will have to start collecting every evidence, from now, to cement your relationship and marriage. CIC may consider him as going for marriage of convenience. With all my sympathy, you will have to look and expect the worst. Also, his history of being illegal in Europe may appear in his police clearance. His background check may take forever. The option for him to come to Canada as a refugee is very slim or even nil because he has already been in safe third country (England). He still can claim refugee at POE in Canada but how would he arrive to this stage?
I am sorry to disappoint you but I am speaking from real experiences.

From the posting the individual is not legal nor has ever been legally admitted in England for a year!!!!!
Regulation 11 applies here!!!!
The only place an PR application like this can be processed is in his country of Nationallity or in a country he was legally admitted for a year and where he resides!!!! He rsides in England.
The fact that someone enters a country and makes a refugee claim does not infer status or that they were legally admitted!!!
This individuals Visa Post is Damascus Syria. Guest can only sponsor him when they are married. The marriage if allowed in any country would be acceptable by CIC. The onus is on them to prove it is a bona fide relationship.
