Subject: In canada illegally
  Hi i´m currently living in Toronto with my common law spouse.

I have over stayed my time and am currently working as an independant contractor as an office manager.

I am from the UK and hold a full English Passport.

I am wanting some idea of how I can become legal,

Will I have to go back to the UK first?

Can I apply while i am here?

What is the best course to take?

Should I own up about my job??

Hope you can shed some light

p.s My girlfriend is a full Canadian Citizen

You can apply under family category sponsorship if you both have lived together for one year and you are capable provide your proof. Or alternatively you can get married and start the sponsorship as married couple.

If I were you: (UNLESS there is something else you did not say):
* I would go to UK. No one in CIC would bother to ask you in the airport whether you have overstayed or not. You can come back as you do not need visa. having said that, you must also be honest about your staying if you are asked or if you have to document this, in your list of stay, in the immigration application forms.

* Your partner can sponsor you from outside Canada. This way, it is faster and easier. You still can visit, as said you do not need visa to enter Canada.

The best course of action is your personal choice based on your personal circumstances.

Your already here "playing house" but do not state for the manditory one year.

Your employed "not legally but employed hopefully assisting with supporting your partners life style.

Having an application for Permanent Residence in process when you arrive back at the airport as A4 suggest may prevent you from gaining admission because your intentions would not be for coming to Canada as a "TEMPORARY PERIOD OF TIME"

You could be refused entry.

It is up to you.

Anonymous4 should not be telling people just because they do not have a visitor visa requirement all persons who wish to visit Canada are admitted.

Maybe Anonymous4 is like George W. and thinks that the terroist on 9/11 where all from Iraq or came through Canada.

I wonder why the Saudia Arabian´s never had to be punished for supporting terroism?

Our respected Mr Roy,

I have never said that admission to Canada is always guaranteed, even for those coming form the visa waiver countries. It is basic.

Grow up Roy. I smell your reaction because you assume this forum is your lion territory....no one else is allowed to come near. This is not your first or last attacks on those who are here to help but you consider them a threat to your business (with sharon of course). I think every one remember Uniden.

I am sure the rest of us can smell your intention.
