Ok this is the situ. i am a Canadian citizen and i want to sponsor my newly married wife ( 2 weeks old marrage ) to Canada. She is currently in the us. She entered the US leagaly and was leagal for 5 years but now she is over staying. She has a work permit to work and a valid drivers licence. No Green card. Can i sponsor her while she is in the US or does she have to go back to her country? How long does this approx take to get her down from the US? She did her Canadian medical and also waiting for the FBI to get back with the finger printing. Then we are planing to send the application. Please any valid advice or sugestions are most welcome.

Read the OP manuals regarding family class and you will see as long as the person was admitted legally for one year and resides in that country they can apply through that Visa post.
