Subject: Very confused, need answers to sponsor my husband
  I´m a canadian born citizen, my husband lives in the US and is a US citizen, we have an 8 month son and another one on the way. He had 2 prior DUI´s in 2000 and 2005, right before he met me. He has completely changed his lifestyle after we met and got married and had a family. I have been the one visiting him in the states because we were afraid he could not come into canada because of his prior DUI´s. Now that I´m expecting another baby on the way it is hard for me to go back and forth. I have a few questions I´ve been searching all over the internet for answers and could not find..I´m hoping someone can lead me in the right direction.

1. We understand he has to undergo rehabilitation process, but what we don´t understand is that his last DUI has not surpassed the 5 year mark and are afraid if we submit and application it will be denied. What can we do so that won´t happen or will my family be apart for the next few years. I really want my kids to be with his father.

2. Do we have to wait till we apply for rehabilitation for me to be able to sponsor him so he can come and be with us in canada?

3. Will I be ineligable to be a sponsor if I have been on income assistance within the last 6 months?
(I had no choice to be on income assistance because of my claim with EI did not go thru due to shortage of hours required to make a claim so the last resort was for me to get income assistance while being on maternity/parental leave)

4. Would it be necessary for me to hire an immigration lawyer in my husbands state to help us with the rehabilitation/sponsorship papers??

Can anyone shine any light on my situation, it is really stressing me out and being pregnant isn´t helping either..so any information will be greatly appreciated.

If your husband did not serve a jail term, there should be no problem sponsoring him. He can also visit you in Canada as far as I know.

Only convictions will pose a problem!

there shouldn´t be a problem for him to come visit you as long if he never been arrested or held in jail, if he had some serious offenses then he should apply for a pardon.

DUI is a serious offense according to Canadian laws. You have not said whether he was arrested or fined. Without knowing your circumstances it is difficult for people to answer you.

If he was arrested then you will have to wait for 5 years or you can ask for minister´s permit which is difficult to get.

Sorry to tell you that CBSA and Homeland security share a criminal database. Once your husband shows up at the Canadian border, his name is going to pop up and more likely, he will be refuse of entry.

He needs to apply for Temporary resident permit every time he wants to enter Canada if he is elegible he should apply for a pardon and get those DUI charges out of his record. Otherwise he is still inadmissible under the Canadian Immigration act.

Hi I appreciate all the answers and I just wanted to add that my husband had served 1 day jail time for his first offense and was given a fine and an alcohol assesment which he had been deemed unsatisfactory which means he´s not an alcoholic, he was just young and irresponsible back then and had his priorities mixed up, now that he has his own family and kids we´re paying the price for his past mistakes =( . I want to know if it is possible for me to still sponsor him to canada or do I have to wait and get him rehabilited first or apply for a pardon? Isn´t pardon´s only available if the crime is commited in canada and not in the US? I am really confused..don´t know where to begin..I want my husband to be with his children asap. Any advice or answers will be greatly appreciated.
