| Subject: UK Citizen marrying a Candian Citizen |

Just need some advice and clarification from someone about this:
I am a British born citizen holding a UK passport, living and working in the UK all my life. At the end of August 2007 I will be marrying a Canadian born citizen (Canadian Passport holder) and the wedding is taking place in Toronto, Canada. A week after the wedding we are both planning on coming to the UK to settle. Question is what visa does my (at that time) wife come into the country with noting that it will only be a week since the wedding date.
On top of all this we have planned our honeymoon in Mexico before we fly back to the UK and therefore my fiancee will need her passport for this trip.
If someone could possibly get back to me with a resolution, it would be very much apprenticed!

This question is more for the the UK immigration board. I assume you mean the UK rather than Canada when you ask "what visa does my wife need to come into the country with"?
Your wife needs to apply for a UK Spousal Visa preferably in Canada (UK Consular Services in Ottawa). This visa will then allow her to stay and work in the UK for two years. Near the end of this time, if you are still married and intend to continue living together, she can apply to stay permanently in the UK.
Of course, Canadian citizens can always visit the UK without a visa for up to 6 months. I believe your wife could also apply for the Spousal Visa within the UK.

However the problem still remains that I can only assume you can apply for a UK spouse visa after the wedding, during which time we are planning on being on our honeymoon. How long does this spouse visa take to be approved and does she have to be in Canada during this period? After the honeymoon (one week) she has already booked her flight to the UK with me. From your reply, are you suggesting that other option could be for her to enter the UK under a tourist visa and then apply for spousal visa in the UK?

Tony,
My understanding is yes, you can both go on your honeymoon to Mexico immediately following your marriage in Canada. Then simply return to the UK (with your wife as a visitor). Make sure you have all marriage and other necessary documents in hand when you return to the UK, and that your wife´s arrival in the UK is with the intention of settling there permanently.
At that time she can apply for the Spousal Visa in the UK. This can be done online as long as you (and spouse) have an address in the UK. You may want to read the website yourself, as the everything you ask is described there. Here is the applicable text on this topic from the Guidance section on Spousal Visas from the UK visa office website:
Can I join my husband, wife, civil partner, fianc?, fianc?e or proposed civil partner in the UK?
You can apply to join your husband, wife, civil partner, fianc?, fianc?e or proposed civil partner in the UK as long as:
* they currently live and are settled in the UK, or
* they are coming to live permanently in the UK, and
* they are not under 18

One more comment. Since I´m not a UK consular expert, these are my interpretations. Since your vacation schedule and plans so depend on all this being correct, I would call the nearest British Consulate (or in the UK the Home Office) beforehand and confirm all this with them.
