Subject: immigrating with kids after divorce
  Hi, I really need some advice and I was wondering if you could help me?

I want to move from the UK to Canafa with my 2 children. I have been divorced for 3.5 months and have joint custody with my ex over the kids.

I live in the UK (British citizen) and my ex lives in Holland (dutch) so he only sees the kids once a month and a few weeks in the summer.
We have an agreement that although we have joint custody the kids live with me fulltime.

What do I need to have for the authorities so that I can move with the kids without being arrested under the Hague convention for kidnapping my own kids?

Any advice or thoughts gratefully welcomed

I am not clear on the specifics, but for sure you are going to need legally verified permission from you ex to bring them to Canada.

Hmm I am just not sure if I need to have sole custody first?

Its going be a nightmare getting him to agree to it but seeing as he told me to take the kids and go back to the UK when we divorced I am not sure how much he can actually say about anything.

you might want to get some professional advice. I know some folks over at RoadtoCanada.com have had some experience in this regard but the entire process is rather confusing for most of us.

Need a written legal authority from Husband (in reply to: immigrating with kids after divorce)
You cannot remove his children from the UK without his written permission backed up by a court order that specifies the grounds and particulars about visitation, and custody.

Without that in hand, you can´t even apply to come to Canada. The Canadian Immigration application papers ask directly about the custody of minor children that are involved in any divorce action.

NO COURT ORDER REQUIRED

Get notarized consent from him in a form of an affidavit that he is not opposed to the kids immigrating to Canada. He gave verbal consent to take them to the UK from Holland so I doubt he would be opposed to get rid of you totally.

An affidavit that he is not opposed is all that is required.

thanks for your replies.

What can I do if he won´t give me the permission?

I know my dutch lawyer said that he could not keep me in Holland as the kids were younger than school age. He does not want us close to him so he can live his own life but he still wants to control mine.......

hi, I have been split up with my ex for over three years now. We have two kids ages 4 and 8. He has no contact with the kids through to him not wanting to see them at all. I would really like to know, if i need his permission to move to canada?? and what legal documentation i would need to allow us to go?? we would really appreciate your feedback.. thankyou.

I am divorced and two kids 5years and 8 years old. Ex wifes parents has citicenship in Kelowna and ex wants to take the kids to Canada to immigrate. I will allow this from South Africa. She has agreed that she will not ask me for maintenance and she will take care off the kids in Canada. Can she do this or will she get money out of me when she is in Canada?

she would have to come after you for support in the jurisdiction where the divorce was granted. So... chances are good that she is going to do what she says.

Too bad you ethically think that is OK.
