Subject: Divorce question
  Hi there,

I am a Canadian Citizen and my wife is from a different country. She is already a landed immigrant and is working on getting her Canadian Citizenship very soon.

We are in the process of divorcing and have kids. My questions are:
- Does she legally have the right to take the kids back with her? (side note: She came here willingly and has a career in Canada as well)
- Do I have additional responsibilities to her in addition to the standard spousal support? I am her sponsor and the 3 year period is already passed.

Any help would be much appreciated...

sponsorship undertaking is a separate issue from support. The length of term is dependent on when you entered the contract with the Canadian government. It used to be 10 years so those rules may still apply to you depending on your sponsorship dates.

A divorce is a divorce and her being a PR should not change the settlement you agree upon. However, you may wish to be very clear in your agreements about the children and custody and the freedom your ex might have of taking them out of the country. Getting them back can prove to be very difficult.

If you don´t all ready have one, get a divorce lawyer now. In this case, your rights are in need of protection, as well as your future finances.
